MTR VEHICLE/COMMERCIAL:  Prohibits commercial motor vehicle drivers who have
been issued certain waivers from driving commercial motor vehicles for public
utilities
AN ACT1
To amend and reenact R.S. 32:408(B)(7)(e), relative to commercial motor vehicle driver2
waivers; to prohibit certain commercial motor vehicle drivers from driving3
commercial motor vehicles for public utilities; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 32:408(B)(7)(e) is hereby amended and reenacted to read as follows:6

(e) Applicants who are issued a waiver are prohibited from transporting13
passengers for hire, manifested hazardous wastes, or hazardous material required to14
be placarded.  In addition, applicants who are issued a waiver pursuant to this15
Paragraph are prohibited from driving commercial motor vehicles for public utilities16
that are regulated by the Louisiana Public Service Commission or the city council17
of the city of New Orleans.18

Abstract: Prohibits commercial motor vehicle drivers issued certain waivers from driving
a commercial motor vehicle for a public utility regulated by the Public Service
Commission or the New Orleans City Council.
Present law allows commercial motor vehicle drivers, who do not meet the vision
requirements in 49 CFR 391.41(b)(10), to drive certain commercial  motor vehicles in La.
only if the driver meets certain qualifications and is issued a waiver.
Proposed law prohibits commercial motor vehicle drivers issued certain waivers permitted
under present law from driving commercial motor vehicles for public utilities regulated by
the Public Service Commission or the city council of the city of New Orleans.
