PUBLIC WORKS: Authorizes DOTD to transfer property destined to be demolished for
public works
AN ACT1
To enact R.S. 48:283, relative to public works by the Department of Transportation and2
Development; to provide for plans, transfer, and relocations concerning buildings3
with historical or cultural significance acquired by the Department of Transportation4
and Development; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 48:283 is hereby enacted to read as follows:7
ยง283.  Historical structures acquired by department; plan for preservation8
A. The department shall inspect any property acquired for a project for9
buildings or structures that may have historical or cultural significance of which the10
department has no use.11
B.  If such a building or structure is identified, the department shall devise12
a plan to preserve it if a parish, municipality, or nonprofit organization has expressed13
an interest in transferring the building or structure.14
C.  The plan shall give priority to transferring the building or structure to a15
parish, municipality, or nonprofit organization, provided that the parish,16
municipality, or nonprofit organization shall bear the costs of any such transfer and17
resulting relocation and that such transfer and relocation does not interfere with the18

D. The department may promulgate rules and regulations in accordance with1
the Administrative Procedure Act, subject to oversight by the House and Senate2
committees on transportation, highways, and public works, as are necessary to3
implement the provisions of this Section.4

Abstract: Requires DOTD to devise a plan to preserve buildings with historical or cultural
significance.
Proposed law provides that when DOTD acquires real property for a project, it shall inspect
the property for any building or structures that may have historical or cultural significance
of which it has no use.  If such a building or structure is identified, the department shall
devise a plan to preserve it if a parish, municipality, or nonprofit organization has expressed
an interest in acquiring the building or structure.
Proposed law requires the plan to give priority to transferring the building or structure to a
parish, municipality, or nonprofit organization provided that the parish, municipality, or
nonprofit organization shall bear the costs of any such transfer and resulting relocation and
that such transfer and relocation  does not interfere with the construction of the project.
Proposed law authorizes the department to promulgate rules and regulations as are necessary
to implement the provisions of proposed law.
