HIGHER EDUCATION: Provides with respect to assets of nonprofit organizations
affiliated with state institutions of postsecondary education
AN ACT1
To enact R.S. 17:3390(G), relative to the management boards of public postsecondary2
education systems; to provide relative to transfers of assets of nonprofit entities3
affiliated with public postsecondary education institutions; and to provide for related4
matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 17:3390(G) is hereby enacted to read as follows:7
ยง3390. Private nonprofit corporations which support public higher education8
institutions; findings; status; private funds9

G.  Subject to applicable provisions of law and any written donor agreement,11
no management board shall assert any claim to nonstate assets held by any nonprofit12
organization established to support a public postsecondary education institution or13
campus or component thereof unless the organization, by action of its governing14
board, approves a transfer of nonstate assets to the management board.15
