ETHICS: Permits supplemental salary or benefits for the executive director of the New
Orleans Public Library from a private foundation that supports the library
AN ACT1
To enact R.S. 42:1111(A)(6), relative to the Code of Governmental Ethics; to provide that2
supplementary salary or benefits provided to the executive director of the New3
Orleans Public Library through a foundation whose purpose is to support the library4
shall be deemed compensation and benefits from the governmental entity to which5
he is duly entitled; and to provide for related matters.6
Notice of intention to introduce this Act has been published7
as provided by Article III, Section 13 of the Constitution of8
Louisiana.9
Be it enacted by the Legislature of Louisiana:10
Section 1.  R.S. 42:1111(A)(6) is hereby enacted to read as follows: 11

(6) Any supplementary compensation or benefits provided to the executive15
director of the New Orleans Public Library from funds or property accruing to the16
benefit of the library pursuant to the approval of the public library board through a17
foundation whose purpose is to support the library shall be deemed for purposes of18
this Subsection as compensation and benefits from the governmental entity to which19
he is duly entitled.20

Section 2. This Act shall become effective on July 1, 2012; if vetoed by the governor1
and subsequently approved by the legislature, this Act shall become effective on July 1,2
2012, or on the day following such approval by the legislature, whichever is later.3

Abstract: Permits supplemental salary or benefits for the executive director of the New
Orleans Public Library through a private foundation the purpose of which is to
support the library.
Present law (ethics code - R.S. 42:1111) in part prohibits a public servant from receiving
anything of economic value, other than compensation and benefits from the governmental
entity to which he is duly entitled, for the performance of the duties and responsibilities of
his office or position.  Includes certain exceptions for: 
(1)Supplementary compensation or benefits to a public higher education employee from
an alumni organization or a foundation, the purpose of which is to aid said college
or university in a philanthropic manner.
(2)Supplementary compensation or benefits provided to the commissioner of higher
education or to an employee of the Board of Regents from a foundation organized
to support higher education.
(3)Supplementary compensation or benefits provided to a member of the faculty,
administration, or staff of the New Orleans Center for Creative Arts from a
foundation organized to support the center. 
Proposed law provides that any supplementary compensation or benefits provided to the
executive director of the New Orleans Public Library from funds or property accruing to the
benefit of the library pursuant to the approval of the public library board through a
foundation whose purpose is to support the library shall be deemed compensation and
benefits from the governmental entity to which he is duly entitled for purposes of 	present
law.
Effective July 1, 2012.
