DISTRICTS/CRIME PREVENT: Provides relative to the Broadmoor Crime Prevention and
Improvement District in East Baton Rouge Parish
AN ACT1
To amend and reenact R.S. 33:9097.8(B), (E)(8), and (F)(1)(b), relative to the Broadmoor2
Crime Prevention and Improvement District in East Baton Rouge Parish; to modify3
the boundaries of the district; to provide with respect to the parcel fee that the parish4
is authorized to impose on behalf of the district; and to provide for related matters.5
Notice of intention to introduce this Act has been published6
as provided by Article III, Section 13 of the Constitution of7
Louisiana.8
Be it enacted by the Legislature of Louisiana:9
Section 1. R.S. 33:9097.8(B), (E)(8), and (F)(1)(b) are hereby amended and10
reenacted to read as follows:11
ยง9097.8.  Broadmoor Crime Prevention and Improvement District12

B. Boundaries.  The boundaries of the district shall be coterminous with the14
boundaries of the Broadmoor Subdivision in East Baton Rouge Parish as established15
in the official subdivision plat filed with the clerk of court of East Baton Rouge16
Parish. The boundaries of the district shall be coterminous with the boundaries of17
the following subdivisions in East Baton Rouge Parish as established by the official18
subdivision plats thereof filed with the clerk of court of East Baton Rouge Parish:19
Broadmoor, East Broadmoor, North Broadmoor Circle, Broadmoor Oaks,20 HB NO. 252

Broadmoor Place, Broadmoor Terrace, Oak Hill, South Broadmoor, Clarice1
Browning Arnold Tract, and Broadmoor Estates. In addition, the district shall2
include lots B-4-1, B-4-2, and B-4-3 and Lot M of the Edmund R. Sharp Property as3
shown by the official records of the  clerk of court of East Baton Rouge Parish.4

E. Powers and duties.  The district, acting through its board of6
commissioners, shall have the following powers and duties:7

(8) To perform or have performed any other function or activity necessary9
for the achievement of the purpose purposes of the district.10
F. Parcel fee.  The governing authority of East Baton Rouge Parish is hereby11
authorized to impose and collect a parcel fee within the district subject to and in12
accordance with the provisions of this Subsection:13
(1)(a)  The fee shall be imposed on each improved and unimproved parcel14
located within the district.15
(b) For the purposes of this Section, a parcel shall be defined as a lot, a16
subdivided portion of ground, or an individual tract on which a residential or17
commercial structure is situated; however, the term "parcel" shall not include18
"condominium parcel" or "condominium property" as defined in R.S.  9:1121.103.19

Section 2. This Act shall become effective upon signature by the governor or, if not21
signed by the governor, upon expiration of the time for bills to become law without signature22
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If23
vetoed by the governor and subsequently approved by the legislature, this Act shall become24
effective on the day following such approval.25 HB NO. 252

Abstract:  Changes the boundaries of the Broadmoor Crime Prevention and Improvement
District in East Baton Rouge Parish and provides that the parcel fee that the parish
is authorized to impose on behalf of the district is not imposed on parcels with
commercial structures.
Present law establishes the Broadmoor Crime Prevention and Improvement District in East
Baton Rouge Parish.  Proposed law retains present law.
Present law provides that the boundaries of the district are coterminous with the boundaries
of the Broadmoor Subdivision in East Baton Rouge Parish.  Proposed law provides that the
boundaries of the district are coterminous with the boundaries of the following subdivisions
in East Rouge Parish:  Broadmoor, East Broadmoor, North Broadmoor Circle, Broadmoor
Oaks, Broadmoor Place, Broadmoor Terrace, Oak Hill, South Broadmoor, Clarice Browning
Arnold Tract, and Broadmoor Estates. Provides that Lots B-4-1, B-4-2, and B-4-3 and Lot
M of the Edmund R. Sharp Property are also included within the district.
Present law authorizes the district to levy a parcel fee. A "parcel" is defined as a lot, a
subdivided portion of ground, or an individual tract on which a residential or commercial
structure is situated.  Proposed law removes tracts with commercial structures from the
definition of "parcel".
  
Effective upon signature of governor or lapse of time for gubernatorial action.
