HOUSE BILL NO. 255
BY REPRESENTATIVES LEGER, ABRAMSON, BROSSETT, LORUSSO, AND
MORENO AND SENATORS MORRELL AND MURRAY
PUBLIC PROPERTY: Authorizes the transfer of specified property by the Orleans Parish
School Board
AN ACT1
To authorize and provide for the transfer of certain property of the Orleans Parish School2
Board; to specify the property which may be transferred and the authorized recipient3
of the property; to provide terms and conditions; and to provide for related matters.4
Notice of intention to introduce this Act has been published5
as provided by Article III, Section 13 of the Constitution of6
Louisiana.7
Be it enacted by the Legislature of Louisiana:8
Section 1. The Orleans Parish School Board, notwithstanding any other provision9
of the law to the contrary, may convey, sell, transfer, or assign and deliver any and all10
interest it may have to the following described property to Kingsley House, Inc:11
Squares 111 and 146 – First Municipal District12
Square 11113
A CERTAIN PORTION OF GROUND located in the First Municipal District of the14
City of New Orleans, Louisiana, comprising all of Square 111, bounded by15
Annunciation, Richard, Constance and Orange Streets, measuring three hundred16
nineteen feet ten inches (319'10''00'") front on Annunciation Street, three hundred17
eighty-three feet six inches and 1 line (383'06''01''') front on Richard Street, three18
hundred nineteen feet ten inches (319'10"00'") front on Constance Street and three19
hundred eighty-three feet six inches and 1 line (383'06''01''') front on Orange Street.20
Square 111 contains approximately 119,230.15 square feet.21

A CERTAIN PORTION OF GROUND located in the First Municipal District of the23
City of New Orleans, Louisiana, in square 146, bounded by Constance, Richard,24
Magazine and Orange Streets, composed of two contiguous areas occupying the25
entire frontage on Constance Street. The first area forms the corner of Richard and26
Constance Streets, consists of lots formerly designated as Lots 15, 16, 17, 18, 19 and27 HLS 12RS-682	REENGROSSED

20, and measures one hundred twenty-five feet four inches (125'04"00'") front on1
Richard Street, the same measure on the side closest to Orange Street, one hundred2
sixty-one feet four inches (161'04"00") front on Constance Street, and the same3
measure on the side closest to Magazine Street. The second area forms the corner4
of Orange and Constance Streets, consists of four former lots, and measures one5
hundred twenty-eight feet (128'00''00''') front on Orange Street, the same measure on6
the side closest to Richard Street, one hundred fifty-eight feet six inches7
(158'06"00'") front on Constance Street and the same measure on the side closest to8
Magazine Street. The two areas in Square 146 contain a total of approximately9
40,434.25 square feet.10
Section 2. The Orleans Parish School Board may enter into such agreements,11
covenants, conditions, and stipulations and execute such documents as are necessary to12
properly effectuate any conveyance, sale, transfer, or assignment and delivery of title to the13
real property described in Section 1 of this Act, all of which as may be more specifically14
described in any such agreements entered into and documents executed by and between the15
school board and Kingsley House, Inc., in exchange of consideration proportionate to the16
appraised value of the real property above described.  If Kingsley House, Inc., determines17
that the property to be purchased from the Orleans Parish School Board is no longer needed18
for the purpose of providing educational and other programs operated by Kingsley House,19
Inc., in New Orleans, Louisiana, in accordance with its mission as a tax-exempt charitable20
organization providing training, health care, early childhood development, day care, and21
other human services to persons domiciled in the state of Louisiana, Kingsley House, Inc.,22
shall, by written notice to the Orleans Parish School Board, offer to sell the property back23
to the Orleans Parish School Board, with improvements, at appraised fair market value, in24
its condition at the time of offering, prior to seeking to dispose of it to any other person or25
entity.  The Orleans Parish School Board shall have sixty days after receipt of the notice to26
accept the offer to sell, and in the absence of acceptance, Kingsley House, Inc., may sell the27
property to any other person or entity.28
Section 3. This Act shall become effective upon signature by the governor or, if not29
signed by the governor, upon expiration of the time for bills to become law without signature30
by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana.  If31
vetoed, by the governor and subsequently approved by the legislature, this Act shall become32

1. Adds provision relative to the sale of the purchased property back to the school
board (prior to it being offered to others) if Kingsley House, Inc., determines the
property is no longer needed.
