Regular Session, 2012 HOUSE BILL NO. 271 BY REPRESENTATIVE LOPINTO GAMBLING/RIVERBOAT: Amends provisions of law regarding inspection of riverboats AN ACT1 To amend and reenact R.S. 27:44.1(D)(1)(a), relative to alternative inspections for2 riverboats; to provide with respect to inspection standards utilizing United States3 Coast Guard criteria; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 27:44.1(D)(1)(a) is hereby amended and reenacted to read as follows:6 ยง44.1. Riverboat inspections; alternative inspections when certificate of inspection7 not issued; inspections for non-certificated vessels8 * * *9 D.(1) The third-party inspector shall certify to the Louisiana Gaming Control10 Board that the vessel is in compliance with the standards necessary to maintain11 either:12 (a) A United States Coast Guard Certificate of Inspection utilizing the13 inspection criteria in effect at the time of the vessel's original construction,14 applicable waivers approved by the United States Coast Guard, and subsequent15 modifications to the configuration and marine staffing recommended by an approved16 third-party inspector as approved by the Louisiana Gaming Control Board that are17 consistent with United States Coast Guard criteria for the current configuration and18 mooring of the vessel; or19 * * *20 HLS 12RS-999 ORIGINAL HB NO. 271 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. [R.S. 1:13(B) and 24:177(E)] Lopinto HB No. 271 Abstract: Provides with respect to inspection standards utilizing U.S. Coast Guard criteria. Present law provides for gaming activities upon licensed riverboats. Present law further provides that a riverboat shall be designated as a non-certificated vessel as defined in R.S. 27:44 if either of the following occur: (1)The U.S. Coast Guard discontinues its issuance of Certificates of Inspection for riverboats. (2) The U.S. Coast Guard declines to issue a Certificate of Inspection for riverboats which are placed into service by the licensee and approved by the board after Aug. 15, 2005. Present law provides that for such boats the La. Gaming Control Board may approve that the non-certificated vessels be inspected by third-party inspectors. Present law further provides that a third-party inspector shall certify to the La. Gaming Control Board that the vessel is in compliance with the standards necessary to maintain either: (1)A U.S. Coast Guard Certificate of Inspection utilizing the inspection criteria in effect at the time of the vessel's original construction; or (2)A certificate of compliance utilizing a combination of applicable marine structural and life safety standards, the National Fire Protection Association Life Safety Code, and the International Building Code as adopted in the state of La. and as accepted by the La. Gaming Control Board, which are suitable to the vessel's present location and configuration. Proposed law provides that applicable waivers approved by the U.S. Coast Guard and subsequent modifications to the configuration and marine staffing recommended by an approved third-party inspector as approved by the La. Gaming Control Board that are consistent with U.S. Coast Guard criteria for the current configuration and mooring of the vessel may be used in evaluating the safety standards of licensed riverboats.
