Regular Session, 2012 HOUSE BILL NO. 317 BY REPRESENTATIVE GISCLAIR PUBLIC CONTRACT/BIDS: Authorizes the use of salvage material in coastal protection and restoration projects AN ACT1 To amend and reenact R.S. 48:264.1, relative to salvaged material; to authorize the use of2 salvage material in coastal protection and restoration projects; to provide for the3 powers and duties of the secretary of the Department of Transportation and4 Development and the Office of Coastal Protection and Restoration; and to provide5 for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 48:264.1 is hereby amended and reenacted to read as follows: 8 ยง264.1. Salvage materials; bridges and roads; coastal protection and restoration9 projects10 A. When, in the opinion of the secretary of the Department of Transportation11 and Development, it is in the best interest of the state, he may order any materials12 deemed of no salvage value recovered from the reconstruction or repair of any state13 road or bridge, or from any other work performed by the department to be disposed14 of by donation to any political subdivision of the state for its use, such donation to15 be made in accordance with a procedure established by the secretary. 16 B. To the extent possible, salvage material recovered from the reconstruction17 or repair of any state road or bridge or from any other work performed by the18 department may be utilized for coastal protection and restoration projects. Present law authorizes the secretary of DOTD to donate, to any political subdivision of the state, materials deemed of no salvage recovered from the reconstruction or repair of any state road or bridge, or from any other work performed by the department. Proposed law authorizes the use of the materials in coastal protection and restoration projects. Requires the secretary to coordinate with OCPR to establish procedures for the donation, delivery, and receipt of the material. (Amends R.S. 48:264.1)
