Regular Session, 2012 HOUSE BILL NO. 321 BY REPRESENTATIVE FANNIN ETHICS/CODE: Exempts certain uncompensated public servants from mandatory ethics education and training requirements in the Code of Governmental Ethics AN ACT1 To amend and reenact R.S. 42:1170(A)(3), relative to mandatory ethics education and2 training; to exempt uncompensated volunteer firemen and uncompensated auxiliary3 or reserve law enforcement officers from such education and training; and to provide4 for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 42:1170(A)(3) is hereby amended and reenacted to read as follows:7 ยง1170. Ethics education; mandatory requirements; ethics designee8 A.9 * * *10 (3)(a) Commencing on January 1, 2012, each public servant who was not11 required to complete education and training pursuant to Paragraph (1) or (2) of this12 Subsection shall receive a minimum of one hour of education and training on the13 Code of Governmental Ethics during each year of his public employment or term of14 office, as the case may be.15 (b) The provisions of Subparagraph (a) of this Paragraph shall not apply to16 any person who is a public servant solely because he serves as an uncompensated17 volunteer fireman or an uncompensated auxiliary or reserve law enforcement officer.18 * * *19 HLS 12RS-380 ENGROSSED HB NO. 321 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. This Act shall become effective upon signature by the governor or, if not1 signed by the governor, upon expiration of the time for bills to become law without signature2 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Present law (R.S. 42:1170(A)-ethics code) requires each public servant to receive a minimum of one hour of education and training on the Code of Governmental Ethics during each year of his public employment or term of office, as the case may be. Present law defines "public servant" as a public employee or an elected official. Proposed law exempts from the mandatory ethics education and training requirement any person who is a public servant solely because he serves as an uncompensated volunteer fireman or an uncompensated auxiliary or reserve law enforcement officer. Otherwise retains present law. Effective upon signature of governor or lapse of time for gubernatorial action.
