COURTS/CITY:  Authorizes an increase in fees for criminal bonds posted in the Denham
Springs City Court
AN ACT1
To enact R.S. 15:85.3, relative to posting of criminal bonds; to provide for an increase in2
fees assessed for criminal bonds in Denham Springs; to provide for collection of fees3
by the marshal of the Denham Springs City Court; to provide for allocation of funds4
to the marshal's general fund; to provide for use of funds for the operational expenses5
of the marshal's office; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 15:85.3 is hereby enacted to read as follows: 8
ยง85.3. Posting of criminal bonds; Denham Springs Marshal's Office; additional fee9
assessed10
A. An additional fee of twenty dollars shall be assessed for every criminal11
bond posted in the city court of Denham Springs. This fee shall be in addition to any12
other fees or fines as provided by law. Any person seeking release by means of a13
criminal bond, or his designated representative, shall pay the fee to the marshal for14
the Denham Springs City Court who shall deposit the funds in the marshal's general15
fund for the city court of Denham Springs.16
B. The monies collected pursuant to the provisions of Subsection A of this17
Section shall be used to supplement the operational expenses of the marshal's office18
for the city court of Denham Springs.  The expenditure of the funds shall be at the19
sole discretion of the marshal of the court.20 HLS 12RS-272	REENGROSSED

C. Any person found not guilty or any person against whom criminal charges1
are brought and thereafter dismissed may petition the city court of Denham Springs2
for a refund of the fee assessed pursuant to the provisions of this Section.3
D. The assessment and disposition of any funds pursuant to this Section shall4
not affect the responsibilities of the city and parish governing authority provided by5
law for the financing of the marshal's office of the city court of Denham Springs.6

Abstract: Authorizes an increase in fees for criminal bonds posted in the Denham Springs
City Court to supplement the operational expenses of the marshal's office.
Proposed law authorizes a fee increase of $20 for all criminal bonds posted in the city court
of Denham Springs to be collected by the marshal for deposit into the marshal's general
fund.
Proposed law requires the additional fees to be used to supplement the operational expenses
for the marshal's office, at the sole discretion of the marshal.
Proposed law authorizes any person to petition the court for a refund of the fee if the person
who is found not guilty or the criminal charges have been dismissed.
Proposed law provides that the financing of the marshal's office by the city and parish
governing authorities shall not be affected by the increase in fees.
