TRANSPORTATION DEPT: Provides for time in which DOTD can issue addenda prior
to the advertised time for opening of bids
AN ACT1
To amend and reenact R.S. 48:252(C)(1), relative to the advertisement of public bids; to2
reduce the time period within which the Department of Transportation and3
Development can issue any addenda; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 48:252(C)(1) is hereby amended and reenacted to read as follows:6
ยง252. Advertisement for bids; public presentment and reading of bids; fee for bid7
proposals8

C.(1) The department shall not issue or cause to be issued any addenda10
materially modifying plans and specifications within a period of ninety-six twenty-11
four hours prior to the advertised time for the opening of bids, excluding Saturdays,12
Sundays, and any other legal holidays; however, if the necessity arises to issue an13
addendum materially modifying the plans or specifications within the14
ninety-six-hour twenty-four-hour period prior to the advertised time for opening15
bids, then the opening of bids shall be extended at least seven days, but not more16
than thirty-five days without the requirement of re-advertising. The department,17
through the issuance of an addendum prior to the scheduled time for bid opening,18
may extend the bid period for up to thirty-five days, without re-advertising.19

Abstract: Changes the time period within which DOTD can issue addenda prior to the
advertised time of public bids.
Present law prohibits the department from issuing any addenda materially modifying plans
and specifications within a period of 96 hours prior to the advertised time for the opening
of bids.
Proposed law reduces the time period to 24 hours.
