HOUSE BILL NO. 426

COURTS/JUSTICE OF PEACE:  Provides relative to venue in justice of the peace courts
AN ACT1
To amend and reenact Code of Civil Procedure Article 4916, relative to justice of the peace2
courts; to provide for venue; to provide for applicability of rules of venue; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  Code of Civil Procedure Article 4916 is hereby amended and reenacted6
to read as follows: 7
Art. 4916.  Venue; justice of the peace courts 8
The rules of venue provided in Articles 41 through 45, and in Articles 71 ,73,9
74, 75, 76, 77, 78, and through 79 apply to suits brought in justice of the peace court10
courts, except where these articles use the word "parish" it shall be construed to mean11
the territorial jurisdiction of the justice of the peace court.12

Present law provides for general rules, exceptions to, and waiver of objections to venue.

Present law provides for exceptions to general venue rules including actions involving
property, disavowal of filiation, custody, marriage of persons related by adoption, open
accounts or promissory notes, adult adoption, and dissolution of a partnership.
Proposed law retains present law and makes present law provisions applicable to suits
brought in justice of the peace courts.
