PROPERTY:  Provides with respect to the form of notice of seizure in judgment debtor
cases
AN ACT1
To amend and reenact Code of Civil Procedure Article 2293(B)(1), relative to notice of2
seizure in judgment debtor cases; to provide for the form of such notice; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. Code of Civil Procedure Article 2293(B)(1) is hereby amended and6
reenacted to read as follows: 7
Art. 2293.  Notice to judgment debtor; appointment of attorney8

B.(1) After the seizure of property, the sheriff shall serve promptly upon the10
judgment debtor a written notice of the seizure and a list of the property seized, in11
the manner provided for service of citation. If service cannot be made on the12
judgment debtor or his attorney of record, the court shall appoint an attorney upon13
whom service may be made. The notice of seizure shall be substantially similar to14
the form provided in R.S. 13:3852.15

Abstract: Requires the notice of seizure in judgment debtor cases to be in a form which is
substantially similar to that required in general seizure cases.
Present law provides procedures for the seizure of property of a judgment debtor to satisfy
a money judgment. Requires the sheriff to serve a written notice of seizure upon the
judgment debtor.  
Proposed law retains present law and provides that such notice of seizure shall be
substantially similar to the form used in general seizure cases.
