EXECUTORY PROCESS: Provides relative to notice of executory process
AN ACT1
To amend and reenact Code of Civil Procedure Article 2724(A), relative to notice in2
executory process proceedings; to provide for notice to certain persons; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. Code of Civil Procedure Article 2724(A) is hereby amended and6
reenacted to read as follows: 7
Art. 2724. Articles relating to sales under fieri facias applicable 8
A. The provisions of Paragraphs A and through C of Article 2293, Articles9
2333 through 2335, and 2337 through 2381, relating to a sale of property under the10
writ of fieri facias, shall apply to a sale of property under the writ of seizure and sale.11

Present law provides for service of notice of a writ of seizure and sale upon a defendant.
Proposed law retains present law and also provides for service of notice upon occupants of
the seized premises.
