CRIME:  Prohibits the false personation of a firefighter
AN ACT1
To amend and reenact R.S. 14:112.1(A)(introductory paragraph) and (1), (B)(2), and (C) and2
to enact R.S. 14:112.1(B)(3), relative to offenses affecting law enforcement; to3
amend the crime of false personation of a peace officer to include firefighters; to4
provide for definitions; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 14:112.1(A)(introductory paragraph) and (1), (B)(2), and (C) are7
hereby amended and reenacted and R.S. 14:112.1(B)(3) is hereby enacted to read as follows:8
ยง112.1.  False personation of a peace officer or firefighter 9
A. False personation of a peace officer or firefighter is the performance of10
any one or more of the following acts with the intent to injure or defraud or to obtain11
or secure any special privilege or advantage: 12
(1) Impersonating any peace officer or firefighter or assuming, without13
authority, any uniform or badge by which a peace officer 	or firefighter is lawfully14
distinguished.15

B.  As used in this Section:17

(2) "Firefighter" means any certified first responder as defined in R.S.19

firefighter regularly employed by a fire department of any municipality, parish, or1
fire protection district of the state of Louisiana, or any volunteer fireman of the state2
of Louisiana.3
(2)(3) "Peace officer" shall include commissioned police officers, sheriffs,4
deputy sheriffs, marshals, deputy marshals, correctional officers, constables, wildlife5
enforcement agents, park wardens, livestock brand inspectors, forestry officers,6
military police, fire marshal investigators, probation and parole officers, attorney7
general investigators, and district attorney investigators.8
C. Whoever commits the crime of false personation of a peace officer or9
firefighter shall be fined not more than one thousand dollars, or imprisoned with or10
without hard labor for not more than two years, or both.11

Abstract: Amends the crime of false personation of a peace officer to also apply to
firefighters.
Present law provides for the crime of false personation of a peace officer and provides
penalties of a fine of not more than $1,000, imprisonment with or without hard labor for not
more than two years, or both.
Proposed law retains provisions of present law and amends the crime to also apply to the
false personation of a firefighter.
Proposed law defines "firefighter" as a certified first responder, certified emergency medical
technician, or any firefighter regularly employed by a fire department of any municipality,
parish, or fire protection district of the state, or any volunteer fireman of the state.
(Amends R.S. 14:112.1(A)(intro. para.) and (1), (B)(2), and (C); Adds R.S. 14:112.1(B)(3))
