GAMBLING/VIDEO POKER: Amends certain amenity provisions for qualified truck stops
AN ACT1
To amend and reenact R.S. 27:306(A)(4)(c)(introductory paragraph), 306(A)(4)(c)(ii)(aa)2
and (bb), and 306(A)(4)(c)(iii)(aa), relative to the operation of video draw poker3
devices at qualified truck stop facilities; to amend the definition of a "qualified truck4
stop facility"; to provide with respect to certain amenity requirements of a qualified5
truck stop facility; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 27:306(A)(4)(c)(introductory paragraph), 306(A)(4)(c)(ii)(aa) and8
(bb), and 306(A)(4)(c)(iii)(aa) are hereby amended and reenacted to read as follows: 9

(c)  As used in this Section, a "qualified truck stop facility" shall mean a15
facility covering at least five developed contiguous acres which sells fuel, lubricating16
oil, and other vehicular merchandise, such as batteries, tires, or vehicle parts for17
eighteen-wheel tractor-trailers, and which also meets all of the following criteria:18

(ii) It must have an on-site restaurant, except for reason of force majeure1
affecting the ability to maintain the on-site onsite restaurant for a reasonable period2
of time as determined by the division following the interruption of such ability,3
which for the purposes of qualifying as a qualified truck stop facility, shall be4
required to have only the following features:5
(aa) Provides seating for at least fifty patrons, 	with all seats located within6
a centralized area.7
(bb)  Provides full table service tables or booths for sit-down meals.8

(iii)  It must have parking areas with each of the following:10
(aa)  A For issuance of the initial license, a stable parking area for at least11
fifty eighteen-wheel tractor-trailer motor vehicles, either paved or concrete, to12
support eighteen-wheel tractor-trailer motor vehicles and their loads, constructed13
according to industry specifications, subject to approval by the division.  All other14
parking areas not paved or concrete must be certified by an authorized company and15
proof provided that compaction tests were conducted, subject to approval by the16
division. Once the division has approved the parking area and issued a license for17
the operation of video draw poker devices, the continued maintenance of the parking18
area shall not be subject to approval or review by the division.19

Abstract: Amends the definition of a "qualified truck stop facility" with regard to certain
amenity provisions.
Present law provides for the licensing and operation of video draw poker devices at qualified
truck stop facilities.
Present law requires a qualified truck stop facility to sell lubricating oil and other vehicular
merchandise, such as batteries, tires, or vehicle parts for 18-wheel tractor-trailers. HLS 12RS-726	ORIGINAL

Proposed law deletes this requirement.
Present law requires such facilities to have an onsite restaurant with seating for at least 50
patrons, with full table service for sit-down meals.
Proposed law requires the seats in the restaurants to be in a centralized location, requires the
restaurant to offer tables or booths, and removes the full table service requirement.
Present law contains certain parking area requirements and restrictions.
Proposed law retains present law for the issuance of the initial license. Further provides that
the continued maintenance of the parking area of a licensed facility shall not be subject to
regulation.
