HOUSE BILL NO. 679

ENVIRONMENT:  Provides for the control of fugitive emissions from rock, concrete, and
asphalt crushing operations
AN ACT1
To enact R.S. 30:2054(B)(11), relative to fugitive emissions from certain air sources;2
provides for the control of fugitive emissions from rock, concrete, and asphalt3
crushing operations; provides for the powers and duties of the secretary of the4
Department of Environmental Quality; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 30:2054(B)(11) is hereby enacted to read as follows:7
ยง2054. Air quality control; secretary of 	environmental quality the Department of8
Environmental Quality; powers and duties9

B.  The secretary shall have the following powers and duties:11

(11) To adopt and promulgate rules and regulations providing for the control13
of fugitive emissions from the construction and operation of rock, concrete, and14
asphalt crushing facilities. In addition to any other requirements deemed necessary15
by the secretary, such rules and regulations shall provide for the following:16
(a) Emission of particulate matter shall be controlled so that the shade or17
appearance of the emission is not denser than twenty percent average opacity, except18
that the emissions may have an average opacity in excess of twenty percent for not19
more than one six-minute period in any sixty consecutive minutes.20 HLS 12RS-1363	ORIGINAL

(b) Emissions of smoke or suspended particulate matter that pass onto or1
across a public road and create a traffic hazard by impairment of visibility or2
intensify an existing traffic hazard condition are prohibited.3
(c) To take all reasonable precautions to prevent particulate matter, including4
but not limited to the following:5
(i)  Open-bodied trucks transporting materials likely to give rise to airborne6
dust shall be covered at all times when in motion.7
(ii) Earth or other material on paved areas within the facility due to transport8
by trucking or other means shall be promptly removed.9
(iii) In-plant roads, active work areas, material stockpiles, and other surfaces10
at the facility shall be watered, treated with dust-suppressant chemicals, oiled, or11
paved and cleaned as necessary to minimize dust emissions to the greatest extent12
practicable.13
(d) If dust cannot be controlled by other means, the department may require14
permanently mounted spray bars to be installed at the inlet and outlet of the crusher,15
at all shaker screens, or at all material transfer points and used as necessary.16
(e) Best housekeeping and maintenance practices shall be employed to17
minimize emissions of organic compounds.18
(f) Require such facilities be surrounded by a fence and that rock, concrete,19
and asphalt shall not be stored outside or above such fence.20
