Regular Session, 2012 HOUSE BILL NO. 715 BY REPRESENTATIVE LEGER SECRETARY OF STATE: Authorizes the secretary of state to charge a fee for filing franchise applications and issuing certificates to those offering cable or video service AN ACT1 To enact R.S. 49:222(B)(13), relative to the powers of the secretary of state; to provide2 relative to the fees chargeable by the secretary of state; to authorize fees relative to3 cable service or video service; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 49:222(B)(13) is hereby enacted to read as follows: 6 ยง222. Fees chargeable by secretary of state7 * * *8 B. The secretary of state is authorized to collect the following fees:9 * * *10 (13) Sixty dollars for filing applications and issuing certificates for state11 franchises to offer cable service or video service in this state.12 Section 2. This Act shall become effective upon signature by the governor or, if not13 signed by the governor, upon expiration of the time for bills to become law without signature14 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Present law authorizes the secretary of state to determine and collect, in accordance with the Administrative Procedure Act, such fees as are reasonably necessary to carry out the duties of the office. Requires the secretary of state to publish a listing of such fees annually in the journal of the state. Proposed law retains present law. Proposed law authorizes the secretary of state to collect a fee of $60 for filing applications and issuing certificates to offer cable service or video service in the state. Effective upon signature of governor or lapse of time for gubernatorial action. (Adds R.S. 49:222(B)(13)) Summary of Amendments Adopted by House Committee Amendments Proposed by House Committee on House and Governmental Affairs to the original bill. 1.
