GERMAIN PROPERTY: Provides relative to the annexation of property by municipalities AN ACT1 To amend and reenact R.S. 33:180(B), relative to annexation; to provide for exclusion of2 certain areas for annexation; and to provide for related matters.3 Be it enacted by the Legislature of Louisiana:4 Section 1. R.S. 33:180(B) is hereby amended and reenacted to read as follows: 5 ยง180. Ordinance to annex territory owned by a public body6 * * *7 B. No municipality may annex the paved portion of a public road without8 including in such annexation all property adjacent to at least one side of the road, the9 paved portion of which is included in the annexation. At the discretion of the10 Department of Transportation and Development, the paved portion of an interstate11 highway right-of-way may be excluded from the annexation without the annexation12 being considered non-contiguous.13 * * *14 Section 2. This Act shall become effective upon signature by the governor or, if not15 signed by the governor, upon expiration of the time for bills to become law without signature16 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Present law provides that no municipality may annex the paved portion of a public road without including in such annexation all property adjacent to at least one side of the road, the paved portion of which is included in the annexation. Proposed law provides that at the discretion of DOTD, the paved portion of an interstate highway right-of-way may be excluded from the annexation without the annexation being considered non-contiguous. Effective upon signature of governor or lapse of time for gubernatorial action. (Amends R.S. 33:180(B))
