Regular Session, 2012 HOUSE BILL NO. 8 BY REPRESENTATIVE SIMON EXCEP PERSON/DISABLED: Corrects the name of an office designated in statutes relative to equal access to governmental and public facilities for the disabled community AN ACT1 To amend and reenact R.S. 40:1737(A), 1738(D), 1741, and 1742(A)(2), relative to equal2 access to governmental and public facilities for the disabled community; to provide3 for proper designation of a certain office of the state; and to provide for related4 matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 40:1737(A), 1738(D), 1741, and 1742(A)(2) are hereby amended and7 reenacted to read as follows: 8 §1737. Violations; enforcement by fire marshal9 A. In cases of practical difficulty or unnecessary hardship, the state fire10 marshal may, after consultation with the office of rehabilitative services, Louisiana11 Rehabilitation Services, grant exceptions from the literal requirements of the12 standards and specifications required by this Part or permit the use of other methods13 or materials. Unless a written exception is granted by the fire marshal, any14 unauthorized deviation from ADA Standards shall be rectified by full compliance15 within ninety days after discovery of the deviation and delivery of a copy of the16 order requiring remedying of the deviation to the occupant or any person in charge17 of the premises personally or by registered or certified mail. Review of plans and specifications before construction begins1 * * *2 D. The fire marshal shall consult with the office of rehabilitative services3 Louisiana Rehabilitation Services in identifying the requirements necessary to4 comply with this Part.5 * * *6 §1741. Educational program by the office of rehabilitative services Louisiana7 Rehabilitation Services and fire marshal8 Subject to appropriation for such purpose, the office of rehabilitative services9 Louisiana Rehabilitation Services and the state fire marshal may provide for10 educating the public and working with officials of cities, local building code11 inspectors, parishes, municipalities and other political subdivisions, private12 architects, designers, planners, and other interested parties in order to encourage and13 help them make all buildings, facilities, and improved areas accessible to and usable14 by persons with disabilities for purposes of rehabilitation, employment, business,15 recreation, and all other aspects of normal living. They shall work with architectural16 schools of the state and the State Board of Architectural Examiners to develop for17 inclusion in the architecture curriculum a course on barrier free design and to18 develop for inclusion in the architectural licensing test a section on barrier free19 design.20 §1742.
