CRIMINAL/RECORDS: Makes a technical correction to the provision regarding the
expungement or destruction of arrest and prosecution records of a sex offender
AN ACT1
To amend and reenact R.S. 44:9(E)(2), relative to arrest and prosecution records; to make2
a technical correction to the provision regarding the expungement of arrest and3
prosecution records of sex offenders; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 44:9(E)(2) is hereby amended and reenacted to read as follows: 6
ยง9. Records of violations of municipal ordinances and of state statutes classified as7
a misdemeanor or felony8

(2) No court shall order the expungement or destruction of any record of the12
arrest and prosecution of any person convicted of a sex offense as defined by R.S.13
15:541(14.1), 15:541, involving a child under the age of seventeen years. The14
provisions of this Paragraph shall apply to all records of any proceedings, order,15
judgment, or other action under Code of Criminal Procedure Article 893.16

Present law provides for a definition of "sex offense" pursuant to R.S. 15:541(24).  
Proposed law makes a technical correction to the provision regarding the expungement or
destruction of arrest or prosecution records of sex offenders to include present law citation
for the definition of "sex offense".
