PUBLIC CONTRACT/BIDS:  Provides relative to the exclusion of certain contractors from
bidding on public projects
AN ACT1
To amend and reenact R.S. 38:2227(A), relative to bidders on public contracts; to revise2
provisions prohibiting certain contractors from bidding on public contracts; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 38:2227(A) is hereby amended and reenacted to read as follows: 6
ยง2227.  Exclusion of certain contractors from bidding7
A. Each public entity advertising and letting for bid a public works contract8
shall require each the lowest bidder, in addition to the provisions of R.S.9
38:2212(A)(3)(c)(ii), after the opening of bids, if a sole proprietor, to attest that he10
has not been convicted of, or has not entered a plea of guilty or nolo contendere to11
any of the crimes or equivalent federal crimes listed in Subsection B of this Section.12
Each The lowest bidding entity shall submit an attestation that no individual partner,13
incorporator, director, manager, officer, organizer, or member, who has a minimum14
of a ten percent ownership in the bidding entity, has been convicted of, or has15
entered a plea of guilty or nolo contendere to any of the crimes or equivalent federal16
crimes listed in Subsection B of this Section.17

Abstract: Revises provisions prohibiting certain contractors from bidding on public
contracts.
Present law provides that each bidder, if a sole proprietor, shall attest that he has not been
convicted of, or has not entered a plea of guilty or nolo contendere to any of the crimes or
equivalent federal crimes listed in present law.
Present law also provides that each bidding entity shall submit an attestation that no
individual partner, incorporator, director, manager, officer, organizer, or member, who has
a minimum of a 10% ownership in the bidding entity, has been convicted of, or has entered
a plea of guilty or nolo contendere to any of the crimes or equivalent federal crimes listed
in present law.  
Proposed law limits the attestation submission to the lowest bidder or bidding entity.
