Regular Session, 2012 HOUSE BILL NO. 996 BY REPRESENTATIVE HOFFMANN PUBLIC CONTRACTS: Clarifies the application of E-Verify AN ACT1 To amend and reenact R.S. 38:2212.10(F) and to enact R.S. 38:2212.10(G), relative to2 public works contracts; to clarify the application of E-Verify; and to provide for3 related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 38:2212.10(F) is hereby amended and reenacted and R.S.6 38:2212.10(G) is hereby enacted to read as follows:7 ยง2212.10. Verification of employees involved in public contract work contracts for8 public works9 * * *10 F. The provisions of this Section shall apply only to contracts for public11 works. For purposes of this Section, "public works" means the operation, erection,12 construction, alteration, improvement, or repair of any public facility or immovable13 property owned, used, or leased by a public entity.14 F. G. Present law provides, generally, that a private employer shall not bid on or otherwise contract with a public entity unless the private employer verifies in a sworn affidavit attesting to both of the following: (1)The private employer is registered and participates in a status verification system to verify that new employees are legal citizens of the U.S. or are legal aliens. (2)The private employer must continue, during the term of the contract, to utilize a status verification system to verify the legal status of all new employees. Proposed law provides that present law shall only apply to contracts for public works. Proposed law defines "public works" as the operation, erection, construction, alteration, improvement, or repair of any public facility or immovable property owned, used, or leased by a public entity.
