HLS 12RS-145 ORIGINAL Page 1 of 2 Regular Session, 2012 HOUSE CONCURRENT RESOLUTI ON NO. 1 BY REPRESENTATIVE GEYMANN BUDGETARY CONTROLS: Reduces the expenditure limit for FY 2012-2013 A CONCURRENT RESOLUTI ON1 To direct the commissioner of administration to change the expenditure limit for Fiscal Year2 2012-2013.3 WHEREAS, the expenditure limit provided for in Article VII, Section 10(C)(1) of4 the Constitution of Louisiana for Fiscal Year 2012-2013 is established as Fifteen Billion One5 Hundred Seventeen Million One Hundred Forty Thousand Eight Hundred Seventy and6 No/100 ($15,117,140,870.00) Dollars; and7 WHEREAS, the state budget indicated that appropriated expenditures for Fiscal Year8 2011-2012 were Eleven Billion Two Hundred Forty-Two Million Six Hundred Eighty-Three9 Thousand Eight Hundred Nine and No/100 ($11,242,683,809.00) Dollars and anticipated10 adjustments were Four Million Six Hundred Fifty-One Thousand Six Hundred Twenty-Four11 and No/100 ($4,651,624.00) Dollars; and12 WHEREAS, if the growth factor used to calculate the expenditure limit had been13 limited to no more than six percent in any year since the expenditure limit was established,14 the expenditure limit for Fiscal Year 2012-2013 would be Twelve Billion Four Hundred15 Forty-Seven Million Two Hundred Sixty-One Thousand One Hundred Seventy-Two and16 No/100 ($12,447,261,172.00) Dollars; and17 WHEREAS, Article VII, Section 10(C)(2) of the Constitution of Louisiana provides18 that the expenditure limit may be changed in any fiscal year by a favorable vote of two-thirds19 of the elected members of each house and that any such change in the expenditure limit shall20 HLS 12RS-145 ORIGINAL HCR NO. 1 Page 2 of 2 be approved by the passage of a specific legislative instrument which clearly states the intent1 to change the limit; and2 WHEREAS, R.S. 39:52.1 of the Louisiana Revised Statutes of 1950 provides that3 a change to the expenditure limit shall be made pursuant to a concurrent resolution adopted4 by a favorable vote of two-thirds of the elected members of each house directing the5 commissioner of administration to change the expenditure limit to a designated amount for6 a specified fiscal year.7 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana, two-thirds of8 the elected members of each house concurring, does hereby direct the commissioner of9 administration to change the expenditure limit for Fiscal Year 2012-2013 from Fifteen10 Billion One Hundred Seventeen Million One Hundred Forty Thousand Eight Hundred11 Seventy and No/100 ($15,117,140,870.00) Dollars to Twelve Billion Four Hundred Forty-12 Seven Million Two Hundred Sixty-One Thousand One Hundred Seventy-Two and No/10013 ($12,447,261,172.00) Dollars.14 BE IT FURTHER RESOLVED that the provisions of this Resolution shall be15 construed to affect the expenditure limit for Fiscal Year 2013-2014 and thereafter in16 accordance with Article VII, Section 10(C) of the Constitution of Louisiana.17 DIGEST The digest printed below was prepared by House Legislative Services.
