CRIMINAL/SENTENCING: Directs the La. Sentencing Commission to study the
feasibility of requiring an offender to serve an imposed sentence through home
incarceration with the use of electronic monitoring
A CONCURRENT RESOLUTI ON1
To direct the Louisiana Sentencing Commission to study the feasibility of requiring an2
offender to serve his term of imprisonment through home incarceration with the use3
of electronic monitoring and to report its findings to the legislature prior to the4
convening of the 2013 Regular Session of the Legislature of Louisiana.5
WHEREAS, according to a study by the PEW Center on the States, Louisiana has6
the highest incarceration rate in the United States; and7
WHEREAS, with this high incarceration rate comes a high monetary cost that is8
borne by the taxpayers in Louisiana; and9
WHEREAS, the mission of the Department of Public Safety and Corrections,10
corrections services, is to enhance public safety through the safe and secure incarceration11
of offenders, effective probation and parole supervision, and proven rehabilitative strategies12
that successfully reintegrate offenders into society, as well as assisting individuals and13
communities victimized by crime; and14
WHEREAS, successful offender reentry and reintegration into the community is a15
matter of critical importance to the public's safety, but reentry is often unsuccessful due to16
the barriers offenders face including a lack of access to family and community support; and17
WHEREAS, the ability of offenders to obtain employment and become productive18
members of their communities is essential to reducing recidivism rates and home19
incarceration with the option of electronic monitoring will allow the offender to successfully20 HLS 12RS-3252	ENGROSSED

reenter society by maintaining ties to his family and community and offering him an1
opportunity to obtain employment; and2
WHEREAS, home incarceration and electronic monitoring encourage successful3
offender reentry, which may serve to reduce crime and the number of crime victims, and4
ultimately ensure opportunities for safer communities; and5
WHEREAS, home incarceration and electronic monitoring may also result in6
significant savings to state and local criminal justice systems; and7
WHEREAS, it is necessary to research, study, and consider a number of factors8
before implementing mandatory home incarceration and electronic monitoring in lieu of9
traditional imprisonment, and those factors include but are not limited to determinations10
made with regard to the type of offender who may be ordered to serve his sentence through11
home incarceration, the cost and feasibility of implementing such a system, the impact on12
the Department of Public Safety and Corrections, sheriffs, local governing authorities, and13
the taxpayers of this state, and the potential impact of home incarceration on recidivism and14
an offender's ability to successfully reenter society.15
THEREFORE, BE IT RESOLVED THAT the Louisiana Legislature does hereby16
direct the Louisiana Sentencing Commission to study the feasibility of requiring an offender17
to serve his term of imprisonment through home incarceration with the use of electronic18
monitoring and to report its findings to the legislature prior to the convening of the 201319
Regular Session of the Legislature of Louisiana.20
