HOUSE CONCURRENT RESOLUTI ON NO. 16
BY REPRESENTATIVE FOIL
DISTRICTS/WATER CONSERVN: Approves certain rules and regulations promulgated
by the Amite River Basin Drainage and Water Conservation District
A CONCURRENT RESOLUTI ON1
To approve rules promulgated by the Amite River Basin Drainage and Water Conservation2
District, hereinafter, "ARBC", relative to the acquisition of property for the Comite3
Diversion Canal Project.4
WHEREAS, R.S. 38:3306(F) provides that the board of the ARBC may expropriate5
property subject to and in accordance with R.S. 48:411 through 460, expropriation6
procedures for the Department of Transportation and Development; and7
WHEREAS, pursuant to R.S. 38:3306(A), the board adopted rules and regulations8
to establish policies and procedures for the acquisition of property for the Comite Diversion9
Canal Project; and10
WHEREAS, R.S. 38:3306(A) provides that such rules and regulations shall be11
submitted to the House of Representatives Committee on Transportation, Highways and12
Public Works and the Senate Committee on Transportation, Highways and Public Works,13
for oversight; and14
WHEREAS, the ARBC complied with the law and submitted the proposed rules to15
both committees, however neither committee held a hearing on the proposed rules; and16
WHEREAS, the subject matter and intent of the proposed rules are of vital17
importance to the people of Ascension, East Baton Rouge, and Livingston Parishes; and 18
WHEREAS, it is also of vital importance that the proposed rules be reviewed for19

WHEREAS, what better process than to have the proposed rules reviewed and1
approved by the Legislature of Louisiana.2
THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby3
declare that it has reviewed and approved the proposed rules of the Amite River Basin4
Drainage and Water Conservation District, relative to the establishment of policies and5
procedures for the acquisition of property for the Comite Diversion Canal Project.6
BE IT FURTHER RESOLVED that the office of the state register is hereby directed7
to print the adopted rules that were submitted in the Notice of Intent published in the state8
register on September 20, 2011.9
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the10
office of the state register, the Amite River Basin Drainage and Water Conservation District,11
and the parish governing authorities of Ascension, East Baton Rouge, and Livingston12
Parishes.13
