HOUSE CONCURRENT RESOLUTI ON NO. 186

ENVIRONMENT:  Urges and requests DEQ to adopt rules and regulations to control
fugitive emission impacts from rock, concrete, and asphalt crushing operations
A CONCURRENT RESOLUTI ON1
To urge and request the Department of Environmental Quality to adopt rules and regulations2
to control fugitive emission impacts from rock, concrete, and asphalt crushing3
operations on human health and the environment.4
WHEREAS, the Louisiana Constitution requires that the healthful, scenic, historic,5
and aesthetic quality of the environment be protected, conserved, and replenished insofar as6
possible and consistent with the health, safety, and welfare of the people; and7
WHEREAS, the Environmental Quality Act requires that the Department of8
Environmental Quality prepare and develop a general plan for the proper control of the air9
resources in the state; and10
WHEREAS, rock, concrete, and asphalt crushing operations are currently taking11
place at a number of locations throughout Louisiana; and12
WHEREAS, fugitive emissions from rock, concrete, and asphalt crushing operations13
and related activities, if not properly controlled, may have off-site impacts to air quality by14
increasing the emissions of fine particulate matter and thereby potentially affecting human15
health and the environment; and16
WHEREAS, such emissions from rock, concrete, and asphalt crushing operations and17
related activities, may also lessen visibility on the public roadways, creating a public18
nuisance and safety hazard; and19
WHEREAS, in September of 2011, the department issued a notice of intent that20
rulemaking procedures were initiated to amend the department's air regulations to provide21 HLS 12RS-4861	ORIGINAL

for a regulatory permit for emissions from address rock, concrete, and asphalt crushing1
operations.2
THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby3
urge and request the Department of Environmental Quality to adopt rules and regulations to4
control fugitive emission impacts from rock, concrete, and asphalt crushing operations on5
human health and the environment.6
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the7
secretary of the Department of Environmental Quality.8
