HOUSE CONCURRENT RESOLUTI ON NO. 186
BY REPRESENTATIVE BARROW AND SENATOR BROOME
A CONCURRENT RESOLUTI ON
To urge and request the Department of Environmental Quality to adopt rules and regulations
to control fugitive emission impacts from rock, concrete, and asphalt crushing
operations on human health and the environment.
WHEREAS, the Louisiana Constitution requires that the healthful, scenic, historic,
and aesthetic quality of the environment be protected, conserved, and replenished insofar as
possible and consistent with the health, safety, and welfare of the people; and
WHEREAS, the Environmental Quality Act requires that the Department of
Environmental Quality prepare and develop a general plan for the proper control of the air
resources in the state; and
WHEREAS, rock, concrete, and asphalt crushing operations are currently taking
place at a number of locations throughout Louisiana; and
WHEREAS, fugitive emissions from rock, concrete, and asphalt crushing operations
and related activities, if not properly controlled, may have off-site impacts to air quality by
increasing the emissions of fine particulate matter and thereby potentially affecting human
health and the environment; and
WHEREAS, such emissions from rock, concrete, and asphalt crushing operations and
related activities, may also lessen visibility on the public roadways, creating a public
nuisance and safety hazard; and
WHEREAS, in September of 2011, the department issued a notice of intent that
rulemaking procedures were initiated to amend the department's air regulations to provide
for a regulatory permit for emissions from address rock, concrete, and asphalt crushing

THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
urge and request the Department of Environmental Quality to adopt rules and regulations to
control fugitive emission impacts from rock, concrete, and asphalt crushing operations on
human health and the environment.
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
secretary of the Department of Environmental Quality.
