TRANSPORTATION: Suspends certain administrative rules relative to access connection
requirements
A CONCURRENT RESOLUTI ON1
To repeal the Department of Transportation and Development rules LAC 70:I.1513(C) and2
(D), 1515(H), and 1521(A) and (B), which provides for access connection3
requirements and permits, and to direct the office of the state register to delete the4
provisions from the Louisiana Administrative Code.5
WHEREAS, certain access connection requirements of the Department of6
Transportation and Development call for unnecessary traffic impact studies; and7
WHEREAS, certain access connection requirements place undue hardships and8
overwhelming burdens on the citizens of this state; and9
WHEREAS, R.S. 49:969 provides that "the legislature, by concurrent resolution,10
may suspend, amend, or repeal any rule or regulation or body of rules or regulations adopted11
by a state department, agency, board, or commission".12
THEREFORE, BE IT RESOLVED by the Legislature of Louisiana that LAC13
70:I.1513(C) and (D), 1515(H), and 1521(A) and (B) are hereby repealed in their entirety.14
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the15
office of the state register.16
BE IT FURTHER RESOLVED that the office of the state register is hereby directed17
to delete LAC 70:I.1513(C) and (D), 1515(H), and 1521(A) and (B) from the Louisiana18

Repeals LAC 70:I.1513(C) and (D), 1515(H), and 1521(A) and (B) of the rules and
regulations promulgated by the Dept. of Transportation and Development, relative to access
connection requirements and permits. Repealed provisions provide for traffic impact studies
and the submission of supporting documentation with the application for the permit. Further
repealed provisions provide for inspection after the initial construction of access
connections. Also repeals rules relative to the location of access connections and a decision
hierarchy used to grant access.
Directs the office of the state register to delete the repealed provisions from the La.
Administrative Code.
