Regular Session, 2012 HOUSE CONCURRENT RESOLUTI ON NO. 69 BY REPRESENTATIVE LIGI ATHLETICS/TRAINERS: Amends administrative rules relative to examination requirements for athletic trainer certification A CONCURRENT RESOLUTI ON1 To amend the Department of Health and Hospitals, Board of Medical Examiners, rule (LAC2 46:XLV.3149), which provides for limitations on examinations of an applicant for3 certification as an athletic trainer, and to direct the office of the state register to print4 the amendments in the Louisiana Administrative Code.5 WHEREAS, the Department of Health and Human Resources, predecessor of the6 Department of Health and Hospitals, promulgated a rule in 1986 providing for limitations7 on examinations of an applicant for certification as an athletic trainer; and8 WHEREAS, this rule is presently in effect and provides that an applicant having9 failed to attain a passing score upon taking the certification examination four times shall not10 thereafter be considered for certification as an athletic trainer and shall not be eligible to take11 the examination again; and12 WHEREAS, among the forty-eight states which regulate the profession of athletic13 training, Louisiana is the only state which limits the number of times an applicant may take14 an athletic trainer certification examination; and15 WHEREAS, at least one state (Illinois) explicitly provides in its regulations relative16 to the profession of athletic training that unsuccessful candidates may retake the examination17 as many times as they wish; and18 HLS 12RS-2147 ORIGINAL HCR NO. 69 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. WHEREAS, among Louisiana's statutes and rules providing for professions and1 occupations, limitations on the number of times an applicant may take an examination to2 qualify for professional certification or licensure are highly uncommon; and3 WHEREAS, R.S. 49:969 provides that the legislature, by Concurrent Resolution,4 may suspend, amend, or repeal any rule adopted by a state department, agency, board, or5 commission; and6 WHEREAS, the purpose of this Resolution is to remove unnecessary obstacles to7 qualified persons attaining employment in a health profession and to meeting demand for8 health care in this state.9 THEREFORE, BE IT RESOLVED by the Legislature of Louisiana that LAC10 46:XLV.3149 is hereby amended to read as follows:11 ยง3149. Restriction, Limitations on Examinations Reexamination12 A. An applicant having failed to attain a passing score upon taking the13 certification examination four times shall not thereafter be considered for14 certification and shall not be eligible to take the examination again may take a15 subsequent examination upon payment of the applicable fee as prescribed by Chapter16 1 of these rules.17 BE IT FURTHER RESOLVED that the clerk of the House of Representatives is18 hereby directed to transmit a copy of this Resolution to the office of the state register and the19 Department of Health and Hospitals, Board of Medical Examiners.20 BE IT FURTHER RESOLVED that the office of the state register is hereby directed21 to have the amendment to LAC 46:XLV.3149 printed and incorporated into the Louisiana22 Administrative Code and to transmit a copy of the revised rule to the Department of Health23 and Hospitals, Board of Medical Examiners.24 HLS 12RS-2147 ORIGINAL HCR NO. 69 Page 3 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Adds provision that an applicant having failed to attain a passing score upon taking the certification examination may take a subsequent examination upon payment of the applicable fee.
