HOUSE CONCURRENT RESOLUTI ON NO. 7

DISTRICTS/DRAINAGE: Memorializes congress to assist the Vermilion Parish Police
Jury regarding the permitting process and mitigation requirements involving
maintenance performed by drainage districts
A CONCURRENT RESOLUTI ON1
To memorialize the United States Congress to take such actions as are necessary to assist the2
Vermilion Parish Police Jury in regards to the regulatory permitting process and3
associated mitigation requirements involving maintenance activity performed by4
drainage districts in the parish.5
WHEREAS, the Vermilion Parish Police Jury designated and created drainage6
districts within the Parish with specific boundaries and appointed certain commissioners to7
perform any and all acts in the district's corporate capacity and its corporate name necessary8
and proper for the carrying on of the purposes and objects of its incorporation as9
contemplated by the statute under which it was organized; and10
WHEREAS, the drainage districts regularly perform maintenance of certain drainage11
facilities which fall under the jurisdiction of federal regulatory agencies which require12
permitting in accordance with Section 404 of the Clean Waters Act and Section 10 of the13
Rivers and Harbors Act; and14
WHEREAS, the drainage districts have experienced extreme delays and financial15
hardships directly related to processing and obtaining the necessary permits and potential16
costly mitigation charges which they are not in a financial position to incur; and17
WHEREAS, the drainage districts have requested assistance from the Vermilion18
Parish Policy Jury in addressing their concerns to certain regulatory agencies.19 HLS 12RS-181 ENGROSSED

THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby1
memorialize the United States Congress to take such actions as are necessary to assist the2
Vermilion Parish Police Jury in regards to the regulatory permitting process and associated3
mitigation requirements involving maintenance activity performed by drainage districts in4
the parish.5
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the6
presiding officers of the Senate and the House of Representatives of the Congress of the7
United States of America, to each member of the Louisiana congressional delegation, and8
to the Vermilion Parish Police Jury.9
