ENROLLED Page 1 of 2 Regular Session, 2012 HOUSE CONCURRENT RESOLUTI ON NO. 7 BY REPRESENTATIVES HENSGENS, CHAMPAGNE, CONNI CK, GISCLAIR, GUINN, HUVAL, NANCY LANDRY, LOPINTO, AND WILLMOTT A CONCURRENT RESOLUTI ON To memorialize the United States Congress to take such actions as are necessary to assist the Vermilion Parish Police Jury in regards to the regulatory permitting process and associated mitigation requirements involving maintenance activity performed by drainage districts in the parish. WHEREAS, the Vermilion Parish Police Jury designated and created drainage districts within the Parish with specific boundaries and appointed certain commissioners to perform any and all acts in the district's corporate capacity and its corporate name necessary and proper for the carrying on of the purposes and objects of its incorporation as contemplated by the statute under which it was organized; and WHEREAS, the drainage districts regularly perform maintenance of certain drainage facilities which fall under the jurisdiction of federal regulatory agencies which require permitting in accordance with Section 404 of the Clean Waters Act and Section 10 of the Rivers and Harbors Act; and WHEREAS, the drainage districts have experienced extreme delays and financial hardships directly related to processing and obtaining the necessary permits and potential costly mitigation charges which they are not in a financial position to incur; and WHEREAS, the drainage districts have requested assistance from the Vermilion Parish Policy Jury in addressing their concerns to certain regulatory agencies. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby memorialize the United States Congress to take such actions as are necessary to assist the Vermilion Parish Police Jury in regards to the regulatory permitting process and associated mitigation requirements involving maintenance activity performed by drainage districts in the parish. ENROLLEDHCR NO. 7 Page 2 of 2 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the presiding officers of the Senate and the House of Representatives of the Congress of the United States of America, to each member of the Louisiana congressional delegation, and to the Vermilion Parish Police Jury.
