VIDEO POKER.  Provides for suitability requirements for video poker license. (8/1/12)
AN ACT1
To amend and reenact R.S. 27:310(D), relative to video draw poker license qualifications;2
to require a lessor of immovable property being utilized as a qualified licensed truck3
stop facility to meet all suitability requirements and qualifications for licensees; and4
to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 27:310(D) is hereby amended and reenacted to read as follows: 7

D. Every person who has or controls directly or indirectly more than a five10
percent ownership, income, or profit interest in an entity which has or applies for a11
license in accordance with the provisions of this Chapter, or ;who receives more than12
five percent revenue interest in the form of a commission, finder's fee, loan13
repayment, or any other business expense related to the gaming operation,; who is14
a lessor of immovable property being utilized by a licensed establishment which15
is a qualified truck stop facility; or who has the ability in the opinion of the16
division, or capacity to exercise a significant influence over the activities of a17 SB NO. 108

licensee authorized or to be authorized by this Chapter, shall meet all suitability1
requirements and qualifications for licensees. For the purposes of this Chapter, all2
gaming related associations, outstanding loans, promissory notes, or other financial3
indebtedness of an applicant or licensee must be revealed to the division for the4
purposes of determining significant influence and suitability.5

DIGEST
Present law requires every person who has or controls directly or indirectly more than a five
percent ownership, income, or profit interest in an entity which has or applies for a license;
who receives more than five percent revenue interest in the form of a commission, finder's
fee, loan repayment, or any other business expense related to the gaming operation; or who
has the ability, in the opinion of the division, to exercise a significant influence over the
activities of a licensee authorized by law to meet all suitability requirements and
qualifications for licensees.
Proposed law retains present law and further requires every person who is a lessor of
immovable property being utilized by a licensed establishment which is a qualified truck
stop facility to meet suitability requirements and qualifications for licensees.
Effective August 1, 2012.
