TRAFFIC. Restricts the use of automated enforcement systems for the detection of speed.

AN ACT1
To enact R.S. 32:43, relative to automated enforcement systems; to prohibit the use of any2
automated enforcement system by a local governmental subdivision or political3
subdivision to issue a violation for exceeding the posted speed limit unless the motor4
vehicle exceeds the posted speed limit by more than ten miles per hour except in a5
school speed zone; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 32:43 is hereby enacted to read as follows: 8
ยง43. Automated Enforcement System; prohibition; speed9
A. No local governmental subdivision, political subdivision, or any10
agency or department thereof, shall utilize any automated enforcement system11
on any highway in this state to issue a citation or violation to, or to impose or12
collect a civil or criminal fine, fee, or penalty on, a person for operating a motor13
vehicle which exceeds the posted speed limit unless such motor vehicle is being14
operated at a speed in excess of ten miles per hour over the posted speed limit15
except in a school speed zone.16
B. For the purposes of this Section, the term "automated enforcement17 SB NO. 172

system", means a camera or an optical device erected alongside a public road,1
street, or highway, or at a traffic light intersection and installed to work in2
conjunction with a traffic control signal or radar speed detection equipment, or3
both, and designed to photographically record images of the license plate or4
other identifying feature of a motor vehicle that is not operated in compliance5
with instruction of a traffic control signal or a posted traffic sign.  The term6
shall also mean a camera or optical device which is attached to a vehicle parked7
along a public road, street, or highway, and installed to work in conjunction8
with a traffic control signal or radar speed detection equipment, or both.9

Proposed law prohibits use by any local governmental subdivision or political subdivision
or any agency or department thereof, of any automated enforcement system to issue a
citation or violation for speed except when the motor vehicle is exceeding the posted speed
limit by more than ten miles per hour except in a school zone. 
Effective August 1, 2012.
