Regular Session, 2012 SENATE BILL NO. 183 BY SENATOR APPEL MUNICIPALITIES. Prohibits local governing authorities from setting certain height limits on amateur radio antennas. (gov sig) AN ACT1 To amend and reenact R.S. 33:102.1(B), relative to amateur radio antennas; to provide for2 regulations related to amateur radio antennas; to prohibit the establishment of a limit3 less than a certain height; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 33:102.1(B) is hereby amended and reenacted to read as follows: 6 ยง102.1. Regulation of amateur radio antennas7 * * *8 B. If a parish or municipality adopts an ordinance or regulation involving the9 placement, screening, or height of an amateur radio antenna based on health, safety,10 or aesthetic conditions, the ordinance or regulation must:11 (1) Reasonably accommodate amateur communications.12 (2) Represent the minimal practicable regulation to accomplish the parish's13 or municipality's legitimate purpose.14 (3) Not limit the height of an antenna or its supporting structure to less15 than twenty feet above the maximum height allowed for any structures or16 buildings under any codes, regulations, or ordinances.17 SB NO. 183 SLS 12RS-387 ORIGINAL Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Section 2. This Act shall become effective upon signature by the governor or, if not1 signed by the governor, upon expiration of the time for bills to become law without signature2 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If3 vetoed by the governor and subsequently approved by the legislature, this Act shall become4 effective on the day following such approval.5 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Michael Bell. DIGEST Present law provides that if a parish or municipality adopts an ordinance or regulation involving the placement, screening, or height of an amateur radio antenna based on health, safety, or aesthetic conditions, the ordinance or regulation must: (1)Reasonably accommodate amateur communications. (2)Represent the minimal practicable regulation to accomplish the parish's or municipality's legitimate purpose. Proposed law retains present law and adds a prohibition that any limitation on the structure shall not be less than 20 feet above the maximum height allowed for any structures or buildings under any codes, regulations, or ordinances. Effective upon signature of the governor or lapse of time for gubernatorial action. (Amends R.S. 33:102.1(B))
