MOTOR VEHICLES. Provides for prestige license plates for the Phi Beta Sigma Fraternity.

AN ACT1
To enact R.S. 47:463.155, relative to special prestige motor vehicle license plates; to provide2
for the creation, issuance, and design of such license plates for the Phi Beta Sigma3
Fraternity, Inc.; to provide relative to the fee and distribution of fees for such plates;4
to authorize the promulgation of rules and regulations; and to provide for related5
matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 47:463.155 is hereby enacted to read as follows: 8
ยง463.155. Special prestige license plate; Phi Beta Sigma Fraternity, Inc.9
A. The secretary of the Department of Public Safety and Corrections10
shall establish a special prestige motor vehicle license plate for Phi Beta Sigma11
Fraternity, Inc., provided there is a minimum of one thousand applicants for12
such plates. These plates shall be restricted to use on passenger cars, pickup13
trucks, recreational vehicles, and vans.14
B. The secretary shall design the plates, which shall be of a color and15
design selected by Phi Beta Sigma Fraternity, Inc., provided that it is in16
compliance with R.S. 47:463(A)(3).17 SB NO. 193

C. The prestige license plate shall be issued, upon application, to any1
citizen of Louisiana in the same manner as any other motor vehicle license plate.2
D. The department shall collect an annual royalty fee of twenty-five3
dollars, which shall be disbursed in accordance with Subsection E of this4
Section. This fee will be in addition to the standard motor vehicle license tax5
imposed by Article VII, Section 5 of the Constitution of Louisiana, and a6
handling fee of three dollars and fifty cents for each plate to be retained by the7
department to offset a portion of administrative cost.8
E. The annual royalty fee shall be collected by the department and9
forwarded to Phi Beta Sigma Fraternity, Inc.  The monies received from the10
royalty fees shall be used for scholarships to Louisiana residents.11
F. The secretary shall adopt rules and regulations as are necessary to12
implement the provisions of this Section.13

Proposed law requires the secretary of the DPS&C to establish special prestige license plates
for Phi Beta Sigma Fraternity, Inc.
Proposed law provides that such prestige license plate shall be issued, upon application, to
any citizen of Louisiana in the same manner as any other motor vehicle license plate.
Proposed law provides for the secretary to design the license plate, with the color and design
to be selected by Phi Beta Sigma Fraternity, Inc., in compliance with R.S. 47:463(A)(3)
(requirements regarding private passenger vehicle license plates).
Proposed law provides for the department to collect an annual royalty fee of $25 and to 
forward such fee to the Phi Beta Sigma Fraternity, Inc., to be used for scholarships to La.
residents. 
Proposed law further provides that such fee shall be in addition to the standard motor vehicle
license tax imposed by Article VII, Section 5 of the Constitution of Louisiana (Motor
Vehicle License Tax) and a handling fee of $3.50 to be retained by the department to offset
a portion of administrative cost.
Proposed law provides that the secretary shall adopt rules and regulations as are necessary
to implement the provisions provided in proposed law.
