TEACHERS RETIREMENT.  Allows retired adjunct professors to avoid benefit suspension
during reemployment, subject to an earnings limitation. (7/1/12) (2/3 - CA 10s29(F))
AN ACT1
To enact R.S. 11:710(A)(5), relative to the Teachers' Retirement System of Louisiana; to2
allow certain retirees reemployed as adjunct professors to receive benefits during3
reemployment; and to provide for related matters.4
Notice of intention to introduce this Act has been published.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 11:710(A)(5) is hereby enacted to read as follows: 7
ยง710.  Employment of retirees8
For purposes of this Section, "retired teacher" shall mean any of the9
following:10

(5) A retired member who returns to active service covered by the12
provisions of this Chapter as an adjunct professor.  For purposes of this13
Paragraph "adjunct professor" shall mean part-time faculty, including14
instructors, assistant professors, associate professors, and professors, assigned15
the professional activities of instructing pupils or conducting research at a16

provided in person or through an approved medium such as television, radio,1
computer, Internet, multimedia telephone, or correspondence and which is2
delivered inside or outside the classroom or in other teacher-student settings.3
Such an adjunct professor's earnings from his return to active service shall not4
exceed twenty-five percent of his benefit during any fiscal year.  If actual5
earnings exceed this amount in any fiscal year, the benefits payable to the6
retiree shall be reduced by the amount in excess of twenty-five percent of his7
benefit.8

Section 2. The cost of this Act, if any, shall be funded with additional employer10
contributions in compliance with Article X, Section 29(F) of the Constitution of Louisiana.11
Section 3. This Act shall become effective on July 1, 2012; if vetoed by the governor12
and subsequently approved by the legislature, this Act shall become effective on July 1,13
2012, or on the day following such approval by the legislature, whichever is later.14

Cortez (SB 20)
Present law generally prohibits any retiree of the Teachers' Retirement System of Louisiana
from receiving a retirement benefit while reemployed, subject to certain narrow exceptions.
Provides that the benefit of a reemployed retiree is suspended for the duration of
reemployment.
Proposed law adds retirees reemployed as adjunct professors engaged in the instruction of
students or in research to the exceptions to present law, allowing such reemployed retirees
to avoid benefit suspension during reemployment.
Proposed law provides that the earnings of any such adjunct professor shall not exceed 25%
of his retirement benefit in any fiscal year.  Further provides that if earnings exceed this
amount, such professor's retirement benefit shall be reduced by the amount in excess of the
25%.
Proposed law requires any cost of proposed law to be funded with additional employer
contributions in compliance with Art. X, Section 29(F) of the state constitution.
Effective July 1, 2012.
