Authorizes the secretary of state to temporarily close certain public facilities under his jurisdiction when no funds are appropriated for the operation of such facilities. (gov sig) AN ACT1 To amend and reenact R.S. 25:376, 379.4 and 1245, and to enact R.S. 25:380.3(C),2 380.24(C), 380.34(C), 380.54(C), 380.64(C), 380.74(C), 380.84(C), 380.94(C),3 380.104(C), 380.114(C), 380.124(C), 380.134(C), 380.154(C) and 380.165(C),4 relative to operations of the Old State Capitol and certain museums; to authorize the5 secretary of state to temporarily close the Old State Capitol and certain museums6 under his jurisdiction when no funds are appropriated for the operation of such7 facilities; and to provide for related matters.8 Be it enacted by the Legislature of Louisiana:9 Section 1. R.S. 25:376, 379.4 and 1245 are hereby amended and reenacted, and R.S.10 25:380.3(C), 380.24(C), 380.34(C), 380.54(C), 380.64(C), 380.74(C), 380.84(C), 380.94(C),11 380.104(C), 380.114(C), 380.124(C), 380.134(C), 380.154(C) and 380.165(C) are hereby12 enacted to read as follows: 13 §376. Operating funds 14 A. The legislature shall provide sufficient funds for the proper operation of15 the Old State Capitol.16 B. Operating funds; appropriations by the legislature7 A. The Department of State shall include in its annual budget request8 submission, as required by R.S. 39:32, a request for funds necessary for support of9 the Louisiana State Exhibit Museum. The governor shall include in the executive10 budget submitted to the legislature sufficient funding for the support of operations11 of the museum.12 B. In the event that funds are not appropriated by the legislature for the13 operation of the Louisiana State Exhibit Museum, the Department of State is14 authorized to temporarily close the museum to the public until such time as15 funds are appropriated by the legislature for the operation of the museum. The16 Department of State shall maintain the museum during any period of17 temporary closure.18 * * *19 §380.3. Operating funds; appropriations by the legislature20 * * *21 C. In the event that funds are not appropriated by the legislature for the22 operation of the Louisiana State Cotton Museum, the Department of State is23 authorized to temporarily close the museum to the public until such time as24 funds are appropriated by the legislature for the operation of the museum. In the event that funds are not appropriated by the legislature for the11 operation of the Garyville Timbermill Museum, the Department of State is12 authorized to temporarily close the museum to the public until such time as13 funds are appropriated by the legislature for the operation of the museum. In the event that funds are not appropriated by the legislature for the9 operation of the Jean Lafitte Marine Fisheries Museum, the Department of10 State is authorized to temporarily close the museum to the public until such11 time as funds are appropriated by the legislature for the operation of the12 museum. The Department of State shall maintain the museum during any13 period of temporary closure.14 * * *15 §380.84. Operating funds; appropriations by the legislature16 * * *17 C. In the event that funds are not appropriated by the legislature for the18 operation of the Tioga Heritage Park and Museum, the Department of State is19 authorized to temporarily close the museum to the public until such time as20 funds are appropriated by the legislature for the operation of the museum. In the event that funds are not appropriated by the legislature for the5 operation of the Louisiana Military Hall of Fame and Museum, the Department6 of State is authorized to temporarily close the museum to the public until such7 time as funds are appropriated by the legislature for the operation of the8 museum. The Department of State shall maintain the museum during any9 period of temporary closure.10 * * *11 §380.154. Operating funds; appropriations by the legislature12 * * *13 C. In the event that funds are not appropriated by the legislature for the14 operation of the Germantown Colony Museum, the Department of State is15 authorized to temporarily close the museum to the public until such time as16 funds are appropriated by the legislature for the operation of the museum. In the event that funds are not appropriated by the legislature for the23 operation of the Schepis Museum, the Department of State is authorized to24 temporarily close the museum to the public until such time as funds are25 appropriated by the legislature for the operation of the museum. Operating funds; appropriations by the legislature1 A. Funds appropriated by the legislature to the Department of State for2 operation of the Eddie G. Robinson Museum shall be used solely for that purpose3 and in accordance with the budget plan developed by the commission.4 B. In the event that funds are not appropriated by the legislature for the5 operation of the Eddie G. Robinson Museum, the Department of State is6 authorized to temporarily close the museum to the public until such time as7 funds are appropriated by the legislature for the operation of the museum. The8 Department of State shall maintain the museum during any period of9 temporary closure.10 Section 2. This Act shall become effective upon signature by the governor or, if not11 signed by the governor, upon expiration of the time for bills to become law without signature12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Proposed law retains present law and provides the secretary of state the authority to temporarily close the Old State Capitol and various museums when no funds are appropriated for the operation of such facilities.
