(6/30/12) AN ACT1 To enact R.S. 22:835(F) and 835.1, relative to the dedication of a portion of the fire marshal2 tax receipts; to provide for the dedication of a portion of such receipts for fire3 protection at Camp Minden; to create the Camp Minden Fire Protection Fund as a4 special fund in the state treasury; to provide for the use of monies in the fund; to5 provide for an effective date; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 22:835(F) and 835.1 are hereby enacted to read as follows: 8 §835. Fire marshal tax; Louisiana Fire Marshal Fund9 * * *10 F. Each year, after satisfaction of the provisions of Subsections C and11 D of this Section, and before any unexpended or unencumbered monies in the12 Louisiana Fire Marshal Fund shall revert to the state general fund, the state13 treasurer shall transfer the amount of fifty thousand dollars to the Camp14 Minden Fire Protection Fund as provided by R.S. 22:835.1.15 §835.1. Camp Minden Fire Protection Fund16 A. Camp Minden Fire Protection Fund, hereinafter referred to as the "fund".1 Annually, the state treasurer shall transfer monies into the fund in accordance2 with the provisions of R.S. 22:835(F). Subject to appropriation by the3 legislature, monies in the fund shall be used solely to provide fire protection at4 the National Guard Installation at Camp Minden to be used to contract with an5 independent fire district to provide for fire protection for Camp Minden. Such6 contract shall be between the independent fire district and the Louisiana7 National Guard.8 B. All unexpended and unencumbered monies in the fund at the end of9 each fiscal year shall remain in the fund. The monies in the fund shall be10 invested by the state treasurer in the same manner as monies in the state11 general fund, and interest earned on the investment of these monies shall be12 credited to the state general fund.13 Section 2. This Act shall become effective on June 30, 2012; if vetoed by the14 governor and subsequently approved by the legislature, this Act shall become effective on15 June 30, 2012, or on the day following such approval by the legislature, whichever is later.16 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Jay R. DIGEST Adley (SB 285) Present law provides for levy of a tax of one and one-fourth percent of the gross annual premium receipts from any business which insures property of any nature against loss by fire. Provides for the deposit of such proceeds into the La. Fire Marshal Fund to be used for the support of the office of the state fire marshal. Unexpended and unencumbered monies in the fund at the end of the year revert to the state general fund. Investment earnings on monies in the fund are credited to the state general fund. Proposed law retains present law relative to the support of the office of state fire marshal but provides for the transfer of $50,000 to the Camp Minden Fire Protection Fund before any unexpended or unencumbered monies revert to the state general fund. Proposed law creates the Camp Minden Fire Protection Fund as a special fund in the state treasury and provides that monies in the fund, subject to an annual appropriation, be used solely for fire protection purposes at the National Guard Installation at Camp Minden. Specifically, the National Guard shall contract for fire protection services with an independent fire district.
