AN ACT1
To enact R.S. 40:2023, relative to the availability of vaccines for the elderly; to provide for2
availability of certain immunizations for elderly inpatients; to provide for the3
payment of such immunizations; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 40:2023 is hereby enacted to read as follows:6
ยง2023. Availability of immunizations recommended by the Centers for Disease7
Control and Prevention8
Beginning October 1, 2012, and each year thereafter, each general9
hospital licensed under this Chapter shall, during the period from October first10
through March first of the following calendar year, in accordance with the latest11
recommendations of the Advisory Committee on Immunization Practices for12
the Centers for Disease Control and Prevention, offer the following13
immunizations to all inpatients sixty-five years of age and older, prior to14
discharge, unless contraindicated for a patient and contingent upon the15
availability of a specific payment in addition to the normal or prevailing level16
of payment, that is at least equal to the product costs and the administrative17
costs for the immunization over and above the reimbursement for in-patient18
care and contingent upon the availability of the vaccine:19

(2) Immunization against pneumococcal diseases if ordered by the1
patient's attending physician.2
