(8/1/12) AN ACT1 To amend and reenact R.S. 32:1253(H), relative to the Motor Vehicle Commission; to2 provide for an appeal of decision of the commission; to provide for venue; and to3 provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:1253(H) is hereby amended and reenacted to read as follows: 6 ยง1253. Motor Vehicle Commission; appointment and qualifications of members;7 terms of office; organization; oath; official bond; compensation;8 powers and duties9 * * *10 H.(1) The commission shall, in addition to the powers herein conferred, be11 constituted a body politic or political corporation, invested with the powers inherent12 in corporations, including but not limited to the power and authority to own13 immovable property. It may sue and be sued under the style of the commission, and14 all process against the commission shall be served on the chairman or executive15 director in person, and all suits on behalf of the commission shall be brought by the16 chairman. Present law provides that the commission may sue and be sued under the style of the commission, and all processes against the commission shall be served on the chairman or executive director in person, and all suits on behalf of the commission shall be brought by the chairman. Present law provides that the domicile of the commission for the purposes of being sued shall be Jefferson Parish. Proposed law adds that an appeal of any decision of the commission may be brought in the district court having jurisdiction over the licensee's place of business or in the 19 th Judicial District Court.
