PUBLIC LANDS.  Authorizes the transfer of certain state properties.  (8/1/12)
AN ACT1
To authorize and provide for the transfer of certain state property; to authorize the transfer2
of certain state property in Ascension Parish; to provide for the property description;3
to provide for reservation of mineral rights; to provide terms and conditions; to4
provide an effective date; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. The commissioner of administration, notwithstanding any other7
provision of law to the contrary, is hereby authorized and empowered to convey,8
transfer, assign, lease or deliver any interest, excluding mineral rights, the state may9
have to all or any portion of the following described parcel of properties, consisting of10
a combined acreage of approximately 14.5 acres, more or less, to Marchand St. Elmo,11
LLC, Hernandez St. Elmo, LLC, and Lindseyville Designs, LLC:12
All of the following properties are situated in the Parish of Ascension, and are13
within what is known as the "Town of St. Elmo" or "St. Elmo Subdivision".14

Section 2. The commissioner of administration is hereby authorized to enter52
into such agreements, covenants, conditions, and stipulations and to execute such53
documents as necessary to properly effectuate any conveyance, transfer, assignment,54
lease or delivery of title, excluding mineral rights, to the property described in Section55 SB NO. 355

1, and as more specifically described in any such agreements entered into and1
documents executed by and between the commissioner of administration and the2
Marchand St. Elmo, LLC, Hernandez St. Elmo, LLC, and Lindseyville Designs, LLC,3
in exchange of consideration proportionate to at least the appraised value of the4
property.5
Section 3. In the event that Marchand St. Elmo, LLC, Hernandez St. Elmo, LLC, and6
Lindseyville Designs, LLC do not acquire the above described properties within three years7
of the effective date of this Act, then the authorization to convey, transfer, assign, lease or8
deliver any interest in the above described properties shall terminate and be null and void.9
Section 4. This Act shall become effective upon signature by the governor or, if not10
signed by the governor, upon expiration of the time for bills to become law without signature11
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If12
vetoed by the governor and subsequently approved by the legislature, this Act shall become13
effective on the day following such approval.14

Provides that 3 years after the effective date the authorization will expire.
Effective upon signature of the governor or lapse of time for gubernatorial action.
