SPECIAL DISTRICTS. Provides relative to 9-1-1 fees for the Orleans Communication

AN ACT1
To amend and reenact R.S. 33:9106.2(B)(1), (C) and (D), relative to the Orleans Parish2
Communication District; to provide for fixed rate service charges relative to 9-1-13
emergency calls; to provide for local elections; and to provide for related matters.4
Notice of intention to introduce this Act has been published.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 33:9106.2(B)(1), (C) and (D) are hereby amended and reenacted to7
read as follows: 8
ยง9106.2. Fixed rate service charge; Orleans Parish9

B.(1) Notwithstanding any other law to the contrary, the governing authority11
of the Orleans Parish Communication District may, by a majority vote, establish a12
fixed rate emergency telephone service charge for 9-1-1 services. The fixed rate13
emergency telephone service charges shall be collected and remitted in the same14
manner as service charges are currently collected. Such service charges shall not15
exceed the following amounts:16

service users.1
(b) Two dollars Three dollars per exchange access line serving commercial2
service users (not to exceed one hundred lines per user).3
(c) One dollar and twenty-six cents per month per wireless commercial4
mobile radio service connection.5
(d) Two dollars per month per residential broadband connection.6
(e) Three dollars per month per commercial broadband connection.7

C.  If such service charges are levied on a flat fee schedule of fixed rates,9
rates shall be uniform for each of the following classes of service:10
(1) Exchange access line serving residential service users.11
(2) Exchange access line serving commercial service users.12
(3) Cellular, commercial mobile radio service (CMRS), or other wireless13
telecommunication service users at the rate for such users provided in Part14
I of Chapter 31 of Title 33 of the Louisiana Revised Statutes of 1950.15
D. Notwithstanding R.S. 33:9108(E), the authority for the Orleans Parish16
Communication District to levy and collect a fixed rate emergency telephone service17
charge pursuant to this Part shall continue on and after December 31, 2009.18
However, on or after January 1, 2010, the district may, by a majority vote of the19
governing authority, reestablish the original emergency telephone service charge in20
effect prior to August 15, 2006, upon which the district may no longer levy and21
collect the fixed rate emergency service charge for 911 services authorized by this22
Section.23
D. Any increase as provided for in Paragraph (B)(1) of this Section shall24
become effective upon a favorable vote of a majority of the electors residing25
within the district and voting at an election for such purpose.26 SB NO. 361

Present law provides that the Orleans Parish Communication District's monthly service
charges shall not exceed $1.00 per exchange access line serving residential service users and
$2.00 per exchange access line serving commercial service users (not to exceed 100 lines
per user).
Proposed law instead provides that the Orleans Parish Communication District's monthly
service charges shall not exceed the following amounts:
(1)$2.00 per exchange access line serving residential service users (increased from
$1.00 as provided in present law).
(2)$3.00 per exchange access line serving commercial service users, not to exceed one
100 lines per user (increased from $2.00 as provided in present law).
(3)$1.26 per month per wireless commercial mobile radio service (CMRS) connection.
(4)$2.00 per residential broadband connection.
(5)$3.00 per commercial broadband connection.
Proposed law requires that if service charges are levied on a flat fee schedule of fixed rates,
the rates shall be uniform in certain classes of service.
Proposed law deletes present law.
Proposed law provides that any increase in charges contained in proposed law is effective
only after a favorable vote of a majority of electors residing within the district and voting
at an election for such purpose.
Effective August 1, 2012.

services users from $3.38 to $3.00.
