Regular Session, 2012 ENROLLED SENATE BILL NO. 363 BY SENATOR MARTINY AN ACT1 To amend and reenact R.S. 27:319(B)(1)(a)(ii) and (b)(iii), relative to penalties for certain2 violations of the Video Draw Poker Devices Control Law; to provide with respect3 to the revocation of a license for certain violations; and to provide for related4 matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 27:319(B)(1)(a)(ii) and (b)(iii) are hereby amended and reenacted7 to read as follows:8 ยง319. Allowing underage persons to play video draw poker devices; penalties;9 revocation of license10 * * *11 B.(1) Violations of Subsection A of this Section shall be penalized by the12 division as follows:13 (a) For allowing a person under the age of twenty-one to play or operate a14 video draw poker device at a licensed establishment, unless the licensee, his15 employee, or agent reasonably believed that the person was twenty-one years old or16 older:17 * * *18 (ii) For a third or subsequent violation, a license revocation hearing shall be19 conducted at which time the board shall determine whether or not there are20 extenuating circumstances pursuant to which a license suspension or revocation21 should not be imposed.22 (b) For allowing a person under the age of twenty-one to play or operate a23 video draw poker device at a licensed establishment when the licensee, his employee,24 or agent is shown to have known or reasonably believed he was allowing a person25 under the age of twenty-one years old to play or operate a video draw poker device,26 or for allowing a person under the age fifteen years old to play or operate a video27 SB NO. 363 ENROLLED Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. draw poker device at a licensed establishment regardless of what the licensee, his1 employee or agent knew or reasonably believed about the age of that person:2 * * *3 (iii) For a third or subsequent violation, a license revocation hearing shall4 be conducted at which time the board shall determine whether or not there are5 extenuating circumstances pursuant to which a license suspension or revocation6 should not be imposed.7 * * *8 Section 2.
