Regular Session, 2012 SENATE BILL NO. 368 BY SENATOR MURRAY WEAPONS. Increases the penalties for illegal carrying of weapons. (8/1/12) AN ACT1 To amend and reenact R.S. 14:95(B)(1), relative to the crime of illegal carrying of weapons;2 to increase the penalties for a first conviction of illegal carrying of weapons; to make3 first offense illegal carrying of weapons a felony; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 14:95(B)(1) is hereby amended and reenacted to read as follows: 6 ยง95. Illegal carrying of weapons7 * * *8 B.(1) Whoever commits the crime of illegal carrying of weapons shall be9 fined not more than five hundred one thousand dollars, or imprisoned, with or10 without hard labor, for not more than six months one year, or both.11 * * *12 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Alden A. Present law makes first offense illegal carrying of weapons a misdemeanor. Proposed law increases the possible fine for first offense illegal carrying of weapons from $500 to $1,000, and increases the possible time of imprisonment from six months to one year, and also adds that imprisonment may be with or without hard labor. Accordingly, proposed law makes first offense illegal carrying of weapons a felony. Proposed law otherwise retains present law. Effective August 1, 2012. (Amends R.S. 14:95(B)(1))
