Regular Session, 2012 ENROLLED SENATE BILL NO. 371 BY SENATOR HEITMEIER AND REPRESENTATIVE BROSSETT AN ACT1 To enact R.S. 40:1300.332, relative to Medicaid; to provide for the Department of Health2 and Hospitals upper payment limit mechanism for outpatient behavioral health3 services for certain Medicaid recipients; to provide for rules and regulations; and to4 provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 40:1300.332 is hereby enacted to read as follows: 7 ยง1300.332. Upper payment limit mechanism for outpatient behavioral health8 services for Medicaid recipients under the age of twenty-one9 A. The Department of Health and Hospitals is authorized to seek10 approval from the Center for Medicare and Medicaid Services of a program11 designed to reimburse non-state, governmental entities through the Medicaid12 program for outpatient behavioral health services to Medicaid recipients under13 the age of twenty-one.14 B. The Department of Health and Hospitals may develop and maintain15 a Medicaid upper payment limit financing methodology for the behavioral16 health services provided for in Subsection A of this Section. The disbursements17 of monies generated by the use of an upper payment limit methodology shall be18 made only in accordance with an approved waiver or state plan amendment.19 The source of the non-federal match for these payments may only be by20 voluntary certification of expenditures or intergovernmental transfer of funds.21 Section 2. This Act shall become effective upon signature by the governor or, if not22 signed by the governor, upon expiration of the time for bills to become law without signature23 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
