BY SENATOR WARD 
WORKERS' COMPENSATION.  Provides for payment of medical benefits within 30 days
rather than 60 days contingent upon medical providers' adoption and utilization of electronic
billing rules and regulations. (8/1/12)
AN ACT1
To amend and reenact R.S. 23:1201(E), relative to timely payment of medical bills; to2
provide for a shorter time frame for timely payment for providers who utilize the3
electronic billing rules and regulations; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 23:1201(E) is hereby amended and reenacted to read as follows: 6
ยง1201. Time and place of payment; failure to pay timely; failure to authorize;7
penalties and attorney fees8

E.(1) Medical benefits payable under this Chapter shall be paid within sixty10
days after the employer or insurer receives written notice thereof, if the provider of11
medical services is not utilizing the electronic billing rules and regulations12
provided for in R.S. 23:1203.2.13
(2) For those providers of medical services who utilize the electronic14
billing rules and regulations provided for in R.S. 23:1203.2, medical benefits15
payable under this Chapter shall be paid within thirty days after the employer16
or insurer receives written notice thereof.17 SB NO. 386

Present law provides that all medical benefits due under the provisions of the workers'
compensation system are due within 60 days after the employer or insurer receives written
notice.
Proposed law retains present law for those medical providers not utilizing the electronic
billing rules and regulations provided for in R.S. 23:1203.2.
Proposed law requires that for those medical providers who avail themselves of the use of
the electronic billing rules and regulations, payments shall be due to these providers within
30 days after the employer or insurer receives written notice.
Effective August 1, 2012.
