LASERS. (7/1/12)
AN ACT1
To enact R.S. 11:411(11), relative to the Louisiana State Employees' Retirement System; to2
provide for system membership; to provide for an effective date; and to provide for3
related matters.4
Notice of intention to introduce this Act has been published.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 11:411(11) is hereby enacted to read as follows: 7
ยง411. Eligibility for membership8
The membership of this system shall be as follows:9

(11) Employees of the Lafitte Area Independent Levee District.11
Section 2. The cost of this Act, if any, shall be funded with additional employer12
contributions in compliance with Article X, Section 29(F) of the Constitution of Louisiana.13
Section 3. Following the effective date of this Act, the governing body of the Lafitte14
Area Independent Levee District may adopt a resolution declaring the district to be a15
participating employer in Louisiana State Employees' Retirement System. Such resolution16
shall be adopted on or before October 1, 2012 and the executive director of the system shall17 SB NO. 39

be provided with a copy of such resolution. Contributions to the system and accrual of1
benefits shall begin with the first pay period following the system's receipt of the resolution.2
If the resolution is not adopted on or before October 1, 2012, the provisions of this Act shall3
be null and void.4
Section 4. This Act shall become effective on July 1, 2012; if vetoed by the governor5
and subsequently approved by the legislature, this Act shall become effective on July 1,6
2012, or on the day following such approval by the legislature, whichever is later.7

Present law provides for membership in the La. State Employees' Retirement System
(LASERS).
Present law (R.S. 11:412) specifies that for purposes of determining eligibility for
membership in LASERS, the legislature shall provide by law whether or not the types of
agency service performed by employees, elected officials, and appointed officials of new
agencies are within the scope of the provisions of present law.
Proposed law retains present law.
Present law (R.S. 38:291(Y)) provides for the Lafitte Area Independent Levee District
(LAILD), created by Act 475 of the 2007 Regular Session.  The Act does not provide for
LASERS membership.
Proposed law adds employees of LAILD to the membership of LASERS.
Proposed law provides that after the effective date of this act and on or before October 1,
2012, LAILD may adopt a resolution declaring the district to be a participating employer in
LASERS. Provides for contributions to the system and accrual of benefits to begin with the
first pay period following the system's receipt of the resolution.  Further provides that if
LAILD does not adopt the resolution on or before October 1, 2012, the provisions of the act
shall be null and void.
Effective July 1, 2012.
