SENATE BILL NO. 396
BY SENATOR CROWE 
PORTS/HARBORS/TERMINALS.  Provides for changes in the board membership of the
Louisiana International Gulf Transfer and Terminal Authority. (gov sig)
AN ACT1
To amend and reenact R.S. 34:3494(A) and (B), relative to the Louisiana International Gulf2
Transfer and Terminal Authority; to provide for changes in the board membership;3
and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 34:3494(A) and (B) are hereby amended and reenacted to read as6
follows: 7
ยง3494. Board of commissioners; qualifications; term; vacancies; compensation8
A. The authority shall be governed by a board of sixteen twelve9
commissioners, consisting of the secretary of the Department of Economic10
Development and the secretary of the Department of Transportation and11
Development, the chairmen of the House and Senate committees on transportation,12
highways, and public works or their designees and twelve eight commissioners13
appointed by the governor to be chosen on the basis of their demonstrated experience14
in maritime or business leadership, or both, and their stature and ability to act15
effectively for the best interests of Louisiana. Such commissioners shall not be16
appointed or elected commissioners or board members of any other Louisiana port.17 SB NO. 396

B. Commissioners shall be chosen as follows:1
(1) One member shall be selected from a list of three nominees submitted by2
the Ports Association of Louisiana.3
(2) One member shall be selected from a list of three nominees submitted by4
the Louisiana Association of Business and Industry.5
(3) One member shall be selected from a list of three nominees submitted by6
the New Orleans Steamship Association.7
(4) One member shall be selected from a list of three nominees submitted by8
the Louisiana River Pilots Association.9
(5) Two One members at large.10
(6) One member appointed by the American Federation of Labor-Congress11
of Industrial Organizations.12
(7) One member shall be selected from a list of three nominees submitted by13
the president of the Louisiana State Senate.14
(8) One member shall be selected from a list of three nominees submitted by15
the speaker of the Louisiana House of Representatives.16
(9) One member shall be selected from a list of three nominees submitted by17
the Mississippi River Maritime Association.18
(10) One member shall be selected from a list of three nominees submitted19
jointly by the chief executive officer and the governing authority of Plaquemines20
Parish. Such nominees shall be residents of Plaquemines Parish.21
(11) One member selected by the New Orleans Public Belt Railway, and22
appointed by the governor, who shall be a non-voting member.23
(12) The commissioners appointed shall be appointed for terms of six seven24
years. A member shall serve until his successor is appointed unless removed as25
provided for in Paragraph (C)(1) of this Section. A commissioner may be26
reappointed, but no commissioner shall serve more than two consecutive terms.27

commissioner who were selected by the Mississippi River Maritime Association; the1
member selected jointly by the chief executive officer and the governing authority of2
Plaquemines Parish; and the non-voting member selected by the New Orleans Public Belt3
Railway; and one of the at large members who shall be chosen by lot shall terminate as of4
the effective date of this Act. The remainder of the commissioners serving on the effective5
date of this Act shall each have their terms extended one year so that they will serve terms6
of seven years.7
Section 3. This Act shall become effective upon signature by the governor or, if not8
signed by the governor, upon expiration of the time for bills to become law without signature9
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If10
vetoed by the governor and subsequently approved by the legislature, this Act shall become11
effective on the day following such approval.12

DIGEST
Present law provides that the Louisiana International Gulf Transfer and Terminal Authority
shall be governed by a board of 16 commissioners, consisting of the secretary of the
Department of Economic Development and the secretary of the Department of
Transportation and Development, the chairmen of the House and Senate committees on
transportation, highways, and public works or their designees and 12 commissioners
appointed by the governor to be chosen on the basis of their demonstrated experience in
maritime or business leadership, or both, and their stature and ability to act effectively for
the best interests of Louisiana. 
Present law provides for the 12 commissioners appointed by the governor as follows:
1. One member selected from a list of 3 nominees submitted by the Ports Association
of Louisiana.
2. One member selected from a list of 3 nominees submitted by the Louisiana
Association of Business and Industry.
3. One member selected from a list of 3 nominees submitted by the New Orleans
Steamship Association.
4. One member selected from a list of 3 nominees submitted by the Louisiana River
Pilots Association.
5. Two members at large.
6. One member appointed by the American Federation of Labor-Congress of Industrial

governor, who shall be a non-voting member.
Proposed law deletes the following appointed commissioners and terminates the terms of the
current members as of the effective date of the proposed law:
1. One of the at large members.
2. The member selected by the Mississippi River Maritime Association.
3. The member selected jointly by the chief executive officer and the governing
authority of Plaquemines Parish.
4. The non-voting member selected by the New Orleans Public Belt Railway.
Effective upon signature of the governor or lapse of time for gubernatorial action.
