SENATE BILL NO. 396
BY SENATOR CROWE 
PORTS/HARBORS/TERMINALS.  Provides for changes in the board membership of the
Louisiana International Gulf Transfer and Terminal Authority. (gov sig)
AN ACT1
To amend and reenact R.S. 34:3494(A) and (B)(3) and to repeal R.S. 34:3494(B)(9), relative2
to the Louisiana International Gulf Transfer and Terminal Authority; to provide for3
changes in the board membership; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 34:3494(A) and (B)(3)are hereby amended and reenacted to read as6
follows: 7
ยง3494. Board of commissioners; qualifications; term; vacancies; compensation8
A. The authority shall be governed by a board of 	sixteen fifteen9
commissioners, consisting of the secretary of the Department of Economic10
Development and the secretary of the Department of Transportation and11
Development, the chairmen of the House and Senate committees on transportation,12
highways, and public works or their designees and twelve eleven commissioners13
appointed by the governor to be chosen on the basis of their demonstrated experience14
in maritime or business leadership, or both, and their stature and ability to act15
effectively for the best interests of Louisiana. Such commissioners shall not be16
appointed or elected commissioners or board members of any other Louisiana port.17 SB NO. 396

B. Commissioners shall be chosen as follows:1

(3) One member shall be selected from a list of three nominees submitted by3
the New Orleans Steamship Louisiana Maritime Association.4

Section 2.  R.S. 34:3494(B)(9) is hereby repealed.6
Section 3. The terms of the members serving on the effective date of this Act as7
commissioners who were selected from the lists submitted by the Mississippi River8
Maritime Association and the New Orleans Steamship Association shall terminate as of the9
effective date of this Act.10
Section 4. This Act shall become effective upon signature by the governor or, if not11
signed by the governor, upon expiration of the time for bills to become law without signature12
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If13
vetoed by the governor and subsequently approved by the legislature, this Act shall become14
effective on the day following such approval.15

Present law provides that the Louisiana International Gulf Transfer and Terminal Authority
shall be governed by a board of 16 commissioners, consisting of the secretary of the
Department of Economic Development and the secretary of the Department of
Transportation and Development, the chairmen of the House and Senate committees on
transportation, highways, and public works or their designees and 12 commissioners
appointed by the governor to be chosen on the basis of their demonstrated experience in
maritime or business leadership, or both, and their stature and ability to act effectively for
the best interests of Louisiana. 
Present law provides for the 12 commissioners appointed by the governor as follows:
1. One member selected from a list of 3 nominees submitted by the Ports Association
of Louisiana.
2. One member selected from a list of 3 nominees submitted by the Louisiana
Association of Business and Industry.
3. One member selected from a list of 3 nominees submitted by the New Orleans

4. One member selected from a list of 3 nominees submitted by the Louisiana River
Pilots Association.
5. Two members at large.
6. One member appointed by the American Federation of Labor-Congress of Industrial
Organizations.
7. One member selected from a list of 3 nominees submitted by the president of the
Louisiana State Senate.
8. One member selected from a list of 3 nominees submitted by the speaker of the
Louisiana House of Representatives.
9. One member selected from a list of 3 nominees submitted by the Mississippi River
Maritime Association.
10.One member selected from a list of 3 nominees submitted jointly by the chief
executive officer and the governing authority of Plaquemines Parish. Such nominees
shall be residents of Plaquemines Parish.
11.One member selected by the New Orleans Belt Railway, and appointed by the
governor, who shall be a non-voting member.
Proposed law reduces the board of commissioners for the Louisiana International Gulf
Transfer and Terminal Authority from 16 to 15 commissioners and reduces from 12 to 11
the commissioners appointed by the governor.
Proposed law deletes the following governor appointed commissioners and terminates the
terms of the current members as of the effective date of the proposed law:
1. The member selected by the New Orleans Steamship Association.
2. The member selected by the Mississippi River Maritime Association.
Proposed law adds the following governor appointed commissioner:
1. One member selected from a list of 3 nominees submitted by the Louisiana Maritime
Association.
Effective upon signature of the governor or lapse of time for gubernatorial action.
(Amends R.S. 34:3494(A) and (B)(3); repeals R.S. 34:3494(B)(9))
Summary of Amendments Adopted by Senate
Committee Amendments Proposed by Senate Committee on Transportation,
Highways, and Public Works to the original bill.
1. Reduces the board of commissioners for the Louisiana International Gulf
Transfer and Terminal Authority 	from 16 to 15 commissioners.
2. Reduces from 12 to 11 the commissioners appointed by the governor.
3. Deletes the following 2 governor appointed commissioners and terminates
the terms of the current members as of the effective date of the proposed law: SB NO. 396
